So thru armslis% I have a guy in TN that wants to buy my gun.  We text'ed back and forth and it is a go.  Then he mentioned he was buying it for a friend.  What now am I libel for?  I obviously can check his license and ask if he is a felon.  But now he told me this and I know it is for someone else.  Any advice?

Textbook definition of a straw purchase.  Walk away.  Walk away quickly.  If I were a believer in conspiracy theories, I'd even say it might be an ATF agent on a fishing expedition.

Fuck that. It's the Man....and if it isn't, it's a shady deal. Run away, not worth the hassle. The thing that makes it seem fore like a fishing experiment is that he established the sale, THEN he told you it was for a friend. Otherwise I feel he would have kept his mouth shut.

It's stuff like that that makes me not sell without an FFL involved.

Armslist is a haven for LEO searching to make a bust. They are looking for people testing the laws and breaking them. I had a guy do the same thing your talking about. He wanted me to sale him a gun in a bordering state and have his brother pick it up since he's in the army. I told him that wasn't legal but if he wanted a penpal, I would be his friend.  LOL he never replied.

Then it's 100% a no-go.

Your options range anywhere from "call the ATF and tell them about the straw purchase and help them arrest the dude" to "Just tell him no, you won't sell it to him and be done with it".  But going through with the transaction should not be one of your options.

Could be legit and he's buying it as a gift for the friend (which does not constitute a straw purchase), but go with your gut.

Straw Purchase only applies to a FFL


Don't know why his friend isn't dealing directly with you, but whatever, I'd still sell it.  Nothing illegal about it.

Walk away. I had people do that on armslist and get real mad and pushy when I back out. Probably Feds or local Leo. Remember 1/4" on the ruby ridge cost a man plenty for a pushy buyer.


If it was a gift they would say it 99% of the time.

you have gotten a mess of good advice in this thread. I would say take it and walk away. there will be other legit buyers.
its not the law here in Ga, but my personal policy is I don`t sell guns to people who do not have a carry permit. Pisses
some people off, but it shows me the buyer is AOK and can prove it.

I know you said you aren't going to sell and that is the right thing to do.

I'll just add that I had 2 strange situations that makes me think the ATF was trolling me.

One was the same, a guy tells me he will buy then says it is for his friend thats out of town at the moment and the other was a guy selling a gun and as we talked said he was from Illinois staying at a friends house here in Wisconsin. He said when I arrive just walk in the side door he'll leave it open

I know people are stupid and all but come on.

Well if you are doing it legal it is going to an FFL. So it is not your concern. Buying gun for someone 2 weeks before Xmas is not unusual. I guess you could drop a note to the FFL if you want, so FFL can make sure the 4473 is properly filled out.
