DMCA Notification Guidelines

AR15.COM and it's properties are protected under Title II of the Digital Millennium Copyright Act. As such, we will respond to any allegations of copyright violations in accordance with the DMCA. Below you will find our policies and takedown notices as required by the DMCA. The following applies to any and all copyright/trademark and owners of intellectual property interested in utilizing this procedure, as well as service users interested in restoring access to material mistakenly taken down.

When a valid DMCA notification is received, the service provider responds under this process by taking down the offending content. On taking down content under the DMCA, we will take reasonable steps to contact the owner of the removed content so that a counter-notification may be filed. On receiving a valid counter-notification, we generally restore the content in question, unless we receive notice from the notification provider that a legal action has been filed seeking a court order to restrain the alleged infringer from engaging in the infringing activity.

AR15.COM will follow the procedures provided in the DCMA to properly enforce rights of copyright holders. When a Proper DMCA notification is received by the designated DMCA Agent, or an administrator becomes otherwise aware that copyright rights are infringed, we will remove or disable access to infringing materials as soon as possible. AR15.COM will not necessarily send a confirmation regarding the removal/disabling.

Repeat Infringer Policy

Users who are deemed repeat infringers will be subject to have their accounts terminated. If you believe that a user is a repeat infringer, please follow the instructions above to contact AR15.COM and provide sufficient information for us to make a decision.

Users who receive multiple warnings for copyright infringement and fail to discontinue these actions will forfeit their memberships under our user agreement. We ask that users please be respectful to authors and do not violate copyright law. Ignorance is not a valid excuse.

Reporting Abuse And Non-DMCA Issues

AR15.COM will act on all abuse reports and confront offending users. Users found to be guilty of our user agreement or any infringement will either receive a warning or be removed from the community. As an online community we strive to uphold not only the laws and regulations required, but also a good sense of online etiquette.

To report abuse in relation to content, files, photos, or any other use of the site, please email [email protected] with a brief description of the issue as well as URLs to the offending material. If you do not include links, we can not help you. All reported abuses will be investigated and action will be taken as quickly as possible.

To File A Proper DMCA Notification

  • Identify yourself as an owner of copyrighted work or exclusive rights that you believe were infringed, or a person acting on behalf of such owner.
  • Provide information reasonably sufficient to permit AR15.COM to contact you. Email is preferred in order to expedite your request, but please provide the following information: name, address, phone number, and email address.
  • Identify the copyrighted work that you believe is being infringed, or if a large number of works are being infringed, a representative list of the works.
  • Identify the location of materials that allegedly are infringing your copyrighted work, by providing URLs on AR15.COM that contain these materials. Please don't send attached images, pdf or other files. We require only a list with AR15.COM URLs. A properly identified request will get immediate results.
  • State that you have "A good faith belief that use of the aforementioned material is not authorized by the copyright owner, its agents, or the law".
  • State that the information in the notice is accurate, under penalty of perjury. You MUST include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  • Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material or activity is infringing may be subject to liability.
  • Sign the notice. If you are providing notice by e-mail, a scanned physical signature or a valid electronic signature will be accepted. If you are providing a letter, you may scan and email the document for quicker results.
  • To expedite your request, notice should be sent to our designated agent along with the properly completed DMCA notice. Both physical and email addresses are available below.

To File A Counter Notification

  • List the URL, if possible containing the material. If you are unable to provide the URL, either the complete topic title, or key words from the topic title will help.
  • Provide your name, address, telephone number, and email address.
  • State that you consent to the jurisdiction of Federal District Court for the judicial district in which you reside.
  • State that you will accept service of process from the person who provided notification to us of the alleged infringement or an agent of such person.
  • State the following: "I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  • Sign the notice. If you are providing notice by e-mail, a scanned physical signature or a valid electronic signature will be accepted. If you are providing a letter, you may scan and email the document for quicker results.
