These bills expand CCW reciprocity, provides protections against civil liabilities in self-defense in your home or vehicle and ELIMINATES the Clark County handgun registration program.

Late last night, the Nevada Legislature adjourned their legislative session sine die and today, Governor Brian Sandoval signed pro-gun Senate Bill 175 and Senate Bill 240 into law. The 2015 legislative session was a successful year for gun owners in the Silver State as huge improvements were made to Nevada’s gun laws.  Please thank Governor Sandoval for signing both SB 175 and SB 240.

SB 175 makes drastic improvements to Nevada’s gun laws.  This is done by improving Nevada’s preemption statutes, ensuring consistency in gun laws throughout the Silver State and most importantly, abolishing handgun registration in Clark County.  SB 175 also improves the self-defense statutes by extending the castle doctrine to include automobiles, protects from civil liability those who have used force justifiably, and creates a rebuttable presumption in state law for when a person is acting in self-defense.  Finally, SB 175 expands the list of out-of-state permits that will be recognized to carry concealed in Nevada.  SB 175 passed the Assembly on May 22 with a 25-17 vote and was signed by Governor Sandoval today.

SB 240, introduced by state Senator Michael Roberson (R-20), requires a court to transmit within 5 business days certain records of adjudication concerning an individual’s mental health to the Central Repository for Nevada Records of Criminal History for purposes relating to purchasing and possessing a firearm. In addition, SB 240 also removes the fees on voluntary background checks and provides provisions to target “straw purchasers.”  Further, SB 240 includes improvements to the state preemption laws and abolishes the handgun registration requirements in Clark County.  SB 240 passed the Assembly on May 21 with a 23-18 vote and was signed by Governor Sandoval today.

As previously reported, Assembly Bill 136, introduced by Assemblyman John Ellison (R-33) was signed by Governor Sandoval on Wednesday, May 27, and will take effect on July 1, 2015.  AB 136 recognizes the right of archery hunters to carry a firearm for personal protection.  While afield, hunters may face threats from large predators or violent crime, and the limitations of archery equipment can leave a hunter helpless.  There is simply no reason why a hunter using a bow and arrow should lose his or her ability, and therefore right, to personal protection.  AB 136 also allows for the adoption of reasonable accommodations for those hunters with certain disabilities.

AB 121, introduced by Assemblymen Jim Wheeler (R-39), John Ellison (R-33) and Brent Jones (R-35), prohibits schools from disciplining certain pupils for simulating a firearm or dangerous weapon or wearing clothes and accessories which depict firearms.  AB 121 passed the Senate on May 22 with a 15-6 vote and has been sent to Governor Sandoval for his signature.

Assembly Bill 167 makes changes to current Nevada law regarding law-abiding gun owners storing and carrying firearms and ammunition on the premises of a family foster home and with foster children.  AB 167 would authorize law-abiding gun owners to store firearms and ammunition on the premise of a foster home in a locked secure storage container.  Further, it would allow an individual to carry a firearm on their person off the property, in the presence of a child, if they possess a permit to carry concealed.  AB 167 passed the Senate last Friday with a 16-3 vote and has been enrolled to be sent to the Governor.

Senate Joint Resolution 11 passed the Assembly on May 4 with a 32-10 vote and has been sent to the Secretary of State.  As previously reported, SJR 11, sponsored by state Senator Scott Hammond (R-18), proposes an amendment to the Nevada constitution that establishes an individual right to hunt, trap and fish in The Silver State.  SJR 11 would ensure that wildlife conservation and management decisions continue to be based on sound science in order to preserve Nevada’s hunting heritage and to protect it against future attacks from well-funded, anti-hunting organizations.  In order to be put before voters on the ballot, this bill must pass two consecutive legislative sessions.  This is the first step to amending the Nevada Constitution to protect Nevadan’s right to hunt, trap and fish.  SJR 11 must also pass the 2017 legislative session.

Unfortunately, a number of bills died in the Senate Judiciary Committee, including several which related to campus carry and parking lots.

I looked up SB229, it's the license plate bill.
Not exactly my burning issue, I probably won't even get one since my CCW gets me enough grief from some of the local schmucks with badges.

At least half of SB240 is a waste as it just reflects Fed. law in Nevada statute.

Now I suppose the Fed's will leave it to Nevada to prosecute those laws at our expense instead of theirs.
So the real criminals will now be able to hire cheaper lawyers and plea-bargain more easily.
End result, wife beaters and straw buyers will do LESS time.
The five day reporting limit for "Mental" is pretty bad as it's unenforceable (Like LE is really going to go after the court clerks and doctors for being slow) while also being poorly defined.
We can expect the mental portion of this to be abused.

Updating this with my senators latest email to me.
THIS update includes more of the effective dates, which are important as technically the improvements do not become real until then.
So blue cards may now be burned, shredded, or flushed!
But no handy-dandy knives until July First.

The 78th (2015) Session of the Nevada Legislature adjourned sine die on June 1, 2015.

SB175
Makes various changes relating to public safety.
Senator Roberson’s bill is a domestic violence gun bill.  It prevents individuals convicted of domestic violence from purchasing a firearm.  It extends the Castle Doctrine to occupied motor vehicles.  It creates reciprocity for anyone who is 21 years old and has a CCW from another jurisdiction that has a test, program, or class, and eliminates Clark County’s gun registration program.   It becomes effective upon passage and approval.  It was signed by Governor Sandoval on June 2, 2015.


SB176
Revises provisions governing certain dangerous or deadly weapons.
Senator Settelmeyer’s bill allows for the possession of switchblade knives, authorizes belt buckle knives, and preempts counties or municipalities from passing knife laws.  It becomes effective July 1, 2015.    It was signed by Governor Sandoval on June 1, 2015.


SB240

Makes certain changes relating to public safety

Senator Roberson’s bill sets time frames on information that a person is not mentally healthy must be sent to the criminal repository.   This will help insure those that are not mentally well will not be allowed to purchase firearms.  .  It becomes effective October 1, 2015 It was signed by Governor Sandoval on June 2, 2015.


AB167 Authorizes the storage and carrying of firearms and ammunition on the premises of a family foster home or by certain persons who reside in a family foster home under certain circumstances. Assemblywoman Fiore’s allows for the storage of firearms and ammunition in foster care homes. It passed the Assembly floor on March 23rd with 26 Yeas and 15 Nays.  It passed the Senate floor on May 29th with 16 Yeas and 3 Nays.  It becomes effective upon passage and approval and is awaiting signature of the governor.

I thought 176 was amended to remove premeption?

I am interested to see how the reciprocity list expands, it looks like any state that requires some form of training will be added to the list so states that just have a pay the tax get a background check will not be given reciprocity.

SB 176 appears to also make it legal to carry concealed any knife, just no machetes.  Except on schools or when committing an other offence.

Looks like another "Half a loaf" law to me.
Some one with "Standing" should easily prevail in court to force the other half as it IS inconsistent to treat knives differently than firearms.
Wonder which if any cities - counties will try to buck the state standard, other than the former blue card fiefdom?

Nevada has let us down (AGAIN).

The recent RINO "Changing of the Guard" has been nothing more than a gaggle of bed-wetting, pabulum sucking, agenda-driven liars and progressive socialists.

I used to look forward to the odd numbered years of the legislature to watch the unfucking of the bad shit they passed in the prior session, so they could pass new legislation that actually was more in line with the lifestyle that we have been accustomed to here in our beloved state of Nevada (kind of like a reset button).

But that didn't happen this time. This past session was a Fuck Nevada session. Taxes, half baked bills, compromises, and bones being thrown to the serfs.

I made Nevada my home almost 40 years ago because of the freedom it offered. I just can't believe what has become of this great state.

It saddens me to the core.

The worst is that THIS time they do not even have the excuse of Fed. blackmail to hide behind!

Speed limit, DUI limit, mandatory seatbelts, and others were insisted on by the Fed., extortion via "We will reduce highway funding if Nevada does not comply".
The legislature tucked tail each time and you know what?
Our highway funding has STILL been reduced despite compliance and our population growth!

Time to elect some folk with spines, but I fear the tipping point is well past and the best we can hope for is delaying the worst rot for another few years.

The few victories we did get this year should at least buy us some time, since they will have to be erased before the sedition going the other way can get much momentum.

Ya know im gonna celebrate the death of the blue card. This was a big infringement and i didn't think i would see it go especially through state legislation.

We should have gotten a lot more but you eat an elephant one bite at a time. I'm going to savor these few moutfuls and keep asking for more. Hopefully we keep getting more 2a friendly folks in and we keep chipping away.

Incrementalism is how the libs have turned this country slowly socialist and it's how we'll take it back. Yeah the checkers were all lined up to keep jumping and clear most of the board and these tards are trying to play backgammon but we got a few points on the board so im gonna drink to that.

The train will be awesome.  All the LA trash can get to Vegas sooner and they might become residents since Nevada doesn't have gun registration anymore.  The moped registration is funny because I owned one and the DMV wouldn't grant me a title because they said it had never been registered.  I had the erasure affidavit sealed in an envelope sent certified with me.  I wonder how they would treat it now.  As far as the rest of the legislature it has been made obviously clear they're concerned with how the public perceives them.  Guns are bad and so are bullys so we need to keep them out of our schools. Taxes are great if you say they're for education even when you let parents put the money to a private or home school.  I can see how people say their vote doesn't matter when "vote" means "what I thought I voted for and what I thought my vote represented."


EDIT: At least now I won't get 7 emails from various groups telling me to contact my legislature about bills then 30 minutes later celebrating our legislature for doing such a great job.

Chuck Muth says there is a provision in the NV Constitution that could force Gov B.S.'s largest tax hike in history to a vote in the 2016 election:

"Article 19, Section 1 of the Nevada Constitution provides for a “Referendum for approval or disapproval of statute or resolution enacted by legislature.”

Unless I’m reading it wrong, it certainly appears that our Constitution allows for “any statute or resolution or any part thereof enacted by the legislature be submitted to a vote of the people” if “a number of registered voters of this state equal to 10 percent or more of the number of voters who voted at the last preceding general election shall express their wish by filing with the secretary of state” a petition calling for its repeal. "

"Fortunately for taxpayers, voter turnout last November was exceptionally low – only 552,326.

That means only around 55,000 Nevada voters are needed to sign a petition to repeal the largest tax increase in Nevada’s history."

This is the text of AB326

This is the section about the cars age:

(1) Has a manufacturer’s rated carrying capacity of 1 ton or
15 less;
16 [(b) Manufactured]
17 (2) Was manufactured at least 25 years before the
18 application is submitted to the Department; and
19 [(c) Containing]
20 (3) Contains only the original parts which were used to
21 manufacture the vehicle or replacement parts that duplicate those
22 original parts.
23 (c) The owner of the passenger car has another passenger car
24 or motorcycle registered with the Department during the entire
25 registration period of the passenger car for which the owner is
26 seeking special license plates pursuant to this section.

I read it as cars will now have to be 25 years old to qualify for classic plates.

This is the section that mentions smog:

15 [4,] 5, the Department shall charge and collect a fee for the first
16 issuance of the special license plates for those [motor vehicles]
17 passenger cars exempted pursuant to NRS 445B.760 from the
18 provisions of NRS 445B.770 to 445B.815, inclusive. The amount of
19 the fee must be equal to the amount of the fee for a form certifying
20 emission control compliance set forth in paragraph (c) of subsection
21 1 of NRS 445B.830.

I don't read that as you need a smog check. I see it as the fee must be equal to the fee for certifying emission control compliance.

Currently only Clark and Washoe counties are the only counties that require a smog check.

Interesting.  AB326 does not show up as a passed bill, but that link Damascus provided shows it as "enrolled".

It looks like they killed the rolling 20 year exemption, and locked the door at 1995 model year.  California did the same thing years ago with the exemption - they locked out at 1979 model years I think.

More interesting was the addition of Section 3.5:

Sec. 3.5. Notwithstanding the provisions of NRS 482.381,
482.3812, 482.3814 and 482.3816, the Department of Motor
Vehicles shall not issue any license plate pursuant to those
provisions on or after July 1, 2015, and before July 1, 2017.

B.S. - he is trying to put SB483 (the biggest tax hike in NV history) on the ballot in 2016.  Someone found a provision in the NV Constitution that allows we the people to override ANYTHING passed by the Legislature.  It takes a petition signed by 10% of the voters who voted in the prior election to get it into the next statewide election.  Then, all it takes is a simple majority vote to repeal the law.  Even if the repeal just makes it to the ballot and doesn't pass, it will prevent those taxes from being increased in the future without another vote, severely limiting the government's power to expand them.  Muth is taking the lead in figuring out how to get the signatures and he has 3 former elected representatives that will push it through the Secretary of State's office and onto the 2016 ballot.

So both parties should be able to find the whips they need to drive voters to the polls.
I expect a record number of "Third Party" candidate wins as a lot of people try to derail the status quo.
If we are really going to try to revoke the B.S. Taxes it's going to take a lot of actual effort, as in circulating the petitions.
I tried to circulate a petition years ago and found that I could barely find anyplace to do so as property managers kept making me leave.
I wonder if we will have greater access with this?

Chuck Muth sent out an update today.  He is meeting with a professional petition company for a proposal.  I guess he got burned in his last volunteer recall effort trying to get the petitions signed.  He says if he can't figure out how to do it with pros then he is not going to be involved.  If he can get a decent bid, then his job will be to raise the cash to pay the bill.  The petition will need approx. 60,000 signatures and he is guessing $5 per signature.
