I personally know a guy who got charged with domestic violence for taking HIS credit card out of his wife's purse after she said she was not going to give it to him. We recently had a case locally go to jury trial for very similar circumstances...the defendant was acquitted. The prosecutor figured the jury had disregarded the part of the instructions where they're not supposed to judge whether the law itself is right or wrong, just whether or not the defendant was in violation of the law as it is written. |
