Utah lawmaker: Guns should be legal without permit However, prevention group thinks process should be tightened SALT LAKE CITY — A Utah lawmaker wants to allow all state residents who can legally have a gun carry and conceal it without a permit. Rep. Carl Wimmer, R-Herriman, said he plans to introduce a bill to eliminate the requirement for a state concealed weapon permit to carry a loaded gun. People who do not live in Utah would still need a permit issued by Utah or another state. The measure is being drafted for the legislative session that begins Jan. 24. Wimmer said it wouldn't change laws about who can legally have a gun. Felons, people who have committed a violent crime and illegal residents are now prohibited from carrying a gun. "If you're a law-abiding, upstanding citizen, you can protect yourself by carrying a gun without a permit," Wimmer said. Alaska, Arizona and Vermont already have similar laws, he said. State concealed weapons law gets national scrutiny PIERRE, S.D. (AP) — As a lawsuit challenging South Dakota's concealed-weapons law gets the attention of national groups, the top Republican in the South Dakota Senate says he doesn't see a need for the law to be changed. A British citizen who lives in Sioux Falls sued the state earlier this month after he was not allowed to renew his concealed-weapons permit. The Legislature changed the concealed weapons law in 2002 to only allow United States citizens to obtain permits. Senate Republican Leader Russell Olson, of Wentworth, said his main priority is preserving gun rights for U.S. citizens. "I'll fight for the rights of the citizens of South Dakota," Olson said Friday. "My concern is for the citizens of our state and our nation." Arizona lawmakers, governor: No gun, ammo limits after Loughner rampageJared Loughner is accused of emptying 31 rounds from his Glock 9 in front of the Safeway in Tucson, enabling him to hit 19 people before he had to reload. Mexican gunman fires across border toward U.S. highway workers FORT QUITMAN, Texas –– At least one Mexican gunman fired a high-powered rifle across the border at four U.S. road workers Thursday in an isolated ghost town east of Fort Hancock, Hudspeth County sheriff's officials said. The bullets did not injure the four men. Mike Doyle, chief deputy of the Hudspeth County Sheriff's Office, said a rancher spotted a white pickup fleeing the area on the Mexican side at 10:30 a.m. –– the time the shots were fired. The bullets stuck private land along the unpaved Indian Hot Springs Road, which is about half a mile from the border fence. Hudspeth County borrowed the land to store gravel and rocks used for road construction. The workers were filling a hole left last year by rainstorm damage. The ghost town of Fort Quitman is 25 miles east of Fort Hancock and 80 miles southeast of El Paso. Fewer than a dozen ranchers raise cattle in the remote area. Dueling Polls on Gun Control
In the wake of the Tucson shootings, CBS News and CNN/Opinion Research Corp. –– among other organizations –– conducted polls asking Americans about their views on gun control. The CBS poll results indicated "there is no significant change in public views on the issue of gun control and gun rights." According to the CNN/ORC poll, 69 percent said they "have not changed their opinion" that more gun control is needed. Then, on Jan. 18, Mayors Against Illegal Guns announced the results of a poll it commissioned which, essentially, confirmed the same results but, somehow, indicate that Americans want and need more gun control. The survey was conducted jointly by Momentum Analysis, a polling firm with Democratic clients, and American Viewpoint, a polling firm with Republican clients. Gun rights aren't sacred in U.S. I believe the United States Constitution is the greatest legal document ever created. We should all know, our current constitution was adopted in 1787 after the founding fathers scrapped the Articles of Confederation, which was our first constitution. Thereafter, the first 10 amendments known as the "Bill of Rights" was added to the Constitution in 1791 and our constitution has been amended another 17 times. What makes our constitution the greatest legal document ever created is the fact that it is a living document. However, it is not the infallible word of God as many wish to believe. The framers of the Constitution were aware that changes would be necessary if the Constitution was to endure as the nation grew, changed and progressed. Most of us know that the original Constitution allowed slavery and did not give women the right to vote. As our nation became more free, amendments were made to change that. Other changes were also made. Bill of Rights protects everyone While it is true that Jared Lee Loughner purchased a gun and committed a horrible crime with it, the Second Amendment was not written to prevent or predict such acts. The Second Amendment was primarily written to protect the American people from an overbearing government that would desire to disarm its citizens. Our wise Founding Fathers knew that the government that they established could eventually become corrupted to the point where it wanted to decide everything for its citizens, take as much of their money from them as they could, and that the members of such government would attempt to exclude themselves from the laws it expects the citizens to follow. Modern examples of such corruption: the liberal left agenda, ridiculous taxation and the unwanted health-care bill, in that order. The Second Amendment was also written in full realization that firearms can and will be used as tools for committing crimes. However, if citizens were not allowed to openly carry and keep guns, then only criminals and law enforcement will have them. That possibility would make criminals more brazen to commit crimes. It is well known that thieves are less likely to steal from a house or business that has a good security system. I write to correct an understandable but nonetheless egregious grammatical error in JT Coyote's attempt to parse the syntax of the Second Amendment in his opinion column. He describes the one-sentence amendment as consisting of "two dependent clauses, each modifying and explaining the other.” Not so. (Not possible either.) The first "clause” is in fact a nominative absolute, and the second is the independent or main clause of the sentence. Let me explain.In its original form the Second Amendment reads as follows: "A well regulated Militia being necessary to the security of a free State, the right of the people to keep and bear Arms shall not be infringed.” An absolute construction in its simplest form consists of a noun or pronoun and a participle that are absolute, i.e., grammatically separate and detached from the main clause, which it modifies adverbially. Example: "Hostages accepted, Caesar led his troops back to camp.” The noun is "Hostages,” the participle "accepted,” and the two words together constitute a nominative absolute. Ammunition Ban Struck Down By CourtApparently some sanity still exists in the judiciary when it comes to gun rights. And it comes from one of the least likely places: California. On Jan. 19 a Fresno Superior Court judge ruled that a California law that would have banned mail order ammunition sales and required all purchases of so-called "handgun ammunition” to be registered was unconstitutionally vague. The law was set to take effect Feb. 1, and the ruling means the burdensome and ill-conceived restrictions on the sales of ammunition will not be enforced.

PETA Accused of Oklahoma Spy Plot 1/27/11 The animal rights group PETA may be stepping into some hot water in the Sooner state. The director of an Oklahoma animal park claims to have evidence that PETA used a former employee as a spy in order to give the park a black eye. Joe Schreibvogel, the director of G.W. Exotic Animal Park, indicated he has a taped confession that proves PETA paid the employee to essentially act as a spy. Schreibvogel says the employee used an external hard drive to copy files from the park’s main computer and that he used a camera to take pictures that might be embarrassing. That camera was allegedly purchased for the employee by PETA. The County Sheriff’s office is currently investigating the claims and whether any laws related to downloading of information were violated. As of press time, no arrests have been made or charges filed. Two NRA-backed bills have been filed in the New Mexico Legislature. Senate Bill 220, sponsored by state Senator George Munoz (D-Gallup), is a NRA-backed "Castle Doctrine" self-defense bill. Obama To Push Gun Control Soon To the dismay of the Brady Campaign and other gun ban groups, President Barack Obama didn’t address gun control during his State of the Union address on January 25th. However, Newsweek reports that "in the next two weeks, the White House will unveil a new gun-control effort,” and that the White House confirms, "Obama will address the gun issue in a separate speech, likely early next month.” According to Newsweek, Obama believes that gun laws have been "too loose for much longer than just the past few weeks” following the murders in Tucson, Arizona. Precisely what President Obama might have in mind is uncertain. Rehberg And Boswell Introduce H.R. 420—"Veterans Heritage Firearms Act" This week, U.S. Representatives Denny Rehberg (R-MT) and Leonard Boswell (D-IA) introduced H.R. 420 –– the "Veterans' Heritage Firearms Act." The legislation would provide a limited amnesty period for veterans who served overseas before 1968. During the amnesty period, the veterans would be able to register war relic firearms without fear of prosecution. This amnesty would also extend to a veteran's lawful heirs who inherit these firearms. During WW II and the Korean War, many veterans acquired war relic firearms, which, at the time, was a lawful practice. Under current law, however, if these firearms are not registered in the National Firearms Registration and Transfer Record, the veteran or his heir may be convicted of illegal possession. Magazine Ban, Gun Show Ban and Even a Gun Ownership Ban...
–– All this and more may come up in the Senate! Friday, February 4, 2011 Since the Tucson tragedy, anti-gun Senator Frank Lautenberg (D-NJ) has been hovering like a vulture, waiting to pick the bones of the victims for political advantage. Now he has his chance. The same Federal Aviation Administration (FAA) reauthorization which provided a vote on the repeal of ObamaCare may well be the vehicle for a series of gun control proposals. Right now, no one knows which amendments will be offered. Democratic leaders like Senator Richard Durbin (D-IL) are threatening to offer anti-gun amendments, and pro-gun Senators like Tom Coburn (R-OK) are considering amendments to protect gun rights. Now, it's entirely possible that senators from both sides will simply retreat to their own corners. In fact, GOA's sources inside the Senate indicate that gun amendments to the FAA bill are unlikely at this point, but there's no way can we count on that –– and risk being caught unprepared. There are three amendments which Lautenberg and Representative Carolyn McCarthy (D-NY) have been nursing since Tucson. The first would limit semi-automatic magazines to 10 rounds, in a reprise of the Clinton ban. The second would effectively shut down all gun shows. It would do this by sending any gun show promoter to prison for up to two years if a SINGLE attendee were not informed of his Brady Law obligations. No one would dare sponsor a gun show under these circumstances. The third anti-gun amendment would allow the Obama administration to seize guns from anyone they choose to place on a "watch list." Feinstein Asks President To Tighten Import Restrictions On Semi-Automatic RiflesOn Tuesday, Sen. Dianne Feinstein (D-Calif.) sent a letter to President Barack Obama, urging him to have the Bureau of Alcohol, Tobacco, Firearms and Explosives review its interpretation of the federal law that provides for the importation of firearms "generally recognized as particularly suitable for or readily adaptable to sporting purposes." Adopting a narrower interpretation of the law would, Feinstein claimed, help reduce violence in Mexico and the United States. As the Supreme Court said in District of Columbia v. Heller (2008), the Second Amendment protects the right to keep and bear arms primarily for self-defense. This means the "sporting purposes" limitation imposed by the Gun Control Act of 1968 is constitutionally suspect, to put it mildly. As previously reported, two NRA-backed bills have been filed in the New Mexico Legislature and have now been assigned to committees where they are awaiting action. Senate Bill 220 is the NRA-backed "Castle Doctrine” self-defense bill which would allow lawful occupants of a dwelling to use any degree of physical force against an intruder. The second, House Bill 140, would eliminate the mandatory mid-term firearms refresher training course currently required for Concealed Handgun Licensees. JANUARY 2011 NSSF-ADJUSTED NICS BACKGROUND CHECKS UP 9.7% The January 2011 NSSF-adjusted National Instant Criminal Background Check System (NICS) figure of 784,856 is an increase of 9.7 percent over the NSSF-adjusted NICS figure of 715,309 in January 2010. For comparison, the unadjusted January 2011 NICS figure of 1,312,544 is an increase of 18 percent over the unadjusted NICS figure of 1,112,312 in January 2010. The adjusted NICS data was derived by NSSF by subtracting out NICS purpose code permit checks used by several states such as Kentucky and Utah for CCW permit application checks as well as checks on active CCW permit databases. Time for Congress to rein in this rogue agency They are coming for your guns any way they can. The Bureau of Alcohol, Tobacco, Firearms and Explosives is waging a war on innocent gun owners, and not surprisingly, the Obama administration has done nothing to keep them in check. You are no doubt aware of how the agency has been going after honest gun dealers in recent years. Combine that with byzantine federal laws and regulations –– subject to BATF interpretation –– and it's no wonder the number of FFL holders has decreased almost 80%. Then there was former National Guardsman David Olofson. In 2008, Olofson's loaned AR-15 malfunctioned at a range –– firing a three-round burst with a single trigger pull. The ATF could only replicate the malfunction after experimenting with different types of ammunition behind closed doors. StuntNew York City's murder, rape, robbery and aggravated assault rates rose last year according to preliminary FBI data, with murders alone increasing by more than 12 percent. But instead of concentrating on crime in New York City, Mayor Bloomberg just spent $100,000 of the NYPD's budget sending police to Arizona to buy guns at a gun show. The "sting" was a waste of money that misleads Americans and did nothing to reduce crime. Talk about an aggressive publicity stunt. Arizona officials had not been informed of the operation, which meant that any potential crimes uncovered by the New York City officers could not be prosecuted. But, instead of spending $100,000, Bloomberg could have learned what he did for the price of a phone call or an Internet search. THE OTHER SHOE For more than three years I've been saying that the next round of gun restrictions will come from agencies and departments, and not through passing laws. That's how President Obama is able to avoid, as he did in the State of the Union Address, talking about gun control. His State Department blocks the importation of hundreds of thousands of WWII surplus rifles from South Korea. No gun control laws were passed. His ATF is trying to call for mandatory reporting of anyone buying two or more long guns anywhere near the Mexican border, (on the backburner now amid complaints, but watch for it's return). But, no gun control laws passed there. The latest is the ATF calling for comments on its plan to prevent importation of shotguns which do not meet an arbitrary "sporting use" mandate (given to us with the passage of the absurd Gun Control Act of 1968). Now that the U.S. Supreme Court has ruled that we have the right to own guns for self protection, there should be absolutely no restrictions on guns based on subjective judgments about whether a gun is used for sport. This new move from the ATF is clearly aimed at the Saiga brand of autoloading shotgun, and one can guess it's because this smoothbore doesn't look like an over and under or double barrel. It's a modern-looking autoloading shotgun often used in three-gun competitions around the country. Competition –– as in sport shooting. Not that "sport" has anything to do with the Second Amendment. |

Rare ocelot observed in southern Arizona
PHOENIX – Arizona Game and Fish Department officials report that a rare ocelot was observed this morning (Feb. 8) in the Huachuca Mountains in southern Arizona. An individual called Game and Fish this morning to report that while he was working in his yard in the Huachuca Mountains, his dogs began barking at a cat-like animal which quickly climbed a tree. The individual drew closer and suspected that the small spotted cat might be an ocelot. An ocelot is a rare and endangered species of cat. The man called Game and Fish and an officer responded to the site and confirmed that it was, in fact, an ocelot. The officer did a non-intrusive, visual inspection of the animal from the ground near the tree, and the animal appeared to be healthy. There was no indication that there had been any dog-to-cat direct interaction, as no wounds were visible on any animal. Ocelots are protected by the Endangered Species Act and should be left alone. If anyone encounters a cat believed to be an ocelot, we would request that all sightings and photos along with observation information be reported immediately to the department. CCRKBA Calls for Senate Investigations of ATFBELLEVUE, WA – The Citizens Committee for the Right to Keep and Bear Arms is urging its members to contact the Senate and demand a full and open inquiry into a controversial gun trafficking sting operation by the Bureau of Alcohol, Tobacco, Firearms and Explosives that may be linked to the December slaying of a federal peace officer. After Customs and Border Protection Agent Brian Terry was killed in a shootout two months ago, two of the guns recovered at the crime scene were traced to a sale that was part of the ATF’s "Project Gunrunner” investigation. U.S. Sen. Charles Grassley (R-IA), ranking Republican on the Senate Judiciary Committee, has asked the ATF about this case, and has been met by bureau stonewalling. In a letter to Attorney General Eric Holder this week, Sen. Grassley said it is time to "come clean” about this operation. "For two years,” said CCRKBA Chairman Alan Gottlieb, "we’ve been hearing from Holder and others in the Obama administration about a so-called ‘iron pipeline’ of American guns across the border. Only after the recent arrests in Arizona did we learn, through court documents, that hundreds of guns were allowed to be purchased by alleged straw buyers, while ATF conducted its investigation. Now, according to various news reports, two of those guns showed up at a crime scene where a federal officer lost his life. What is going on here? |

Denny Rehberg Sponsors Legislation to Allow Import of Legal M1 Semi-Automatic RiflesWASHINGTON, D.C. – Montana’s Congressman, Denny Rehberg, sponsored legislation to compel the State Department to allow the importation of 857,470 lawful M1 semi-automatic rifles into the United States. The rifles were relics from the Korean War, which are being sold by South Korea in an effort to raise money for its military. These rifles would be made available to the public as well as to museums and historical societies. "Whether it’s importing legal rifles or blaming legal firearms sales for the violence of Mexican drug criminals, this State Department has appointed itself as the spearhead of regulatory gun control in America,” said Rehberg, a member of the Second Amendment Task Force. "Americans should not apologize for our freedom. We shouldn’t feel bad for insisting that our government respects our rights.
