In for inevitable DD (destructive device) ruling after the "it should be gtg on sbr lower", due to the "caliber" of the can.....Coca Cola is now a destructive device

I suspect it may have to do w/ the length of the barrel inside the tube.  If that's the case they'd have to lengthen it a lot.

Not sure by that standard why it'd be an AOW on a pistol though if it's a SBR on a rifle lower.

Why wouldn't it be?

They're saying it's an SBR when mated to a lower and non-firearm when it's connected to nothing.

ATF are petty tyrant fucktards?

Also the "barre"l is closed and ported so there's no projectile exiting the "barrel", the sleeve itself is the functional barrel.

It's a non-rifled muzzle loader.  No more a DD than an antique black powder cannon.

Maybe someone can clarify.  If you have a registered MG, you can have any barrel length you like because it's covered under your MG tax stamp, correct?  But because this is now a DD the upper would require its own stamp regardless of what stamp the lower has

They aren't claiming it's a DD.  They're claiming it is an SBR when attached to a lower.

I'll start with the AOW, because I know that they're wrong.

An AOW must be able to fire fixed ammunition.  The can cannon, to the best of my knowledge, must be used with blanks.  The use of real ammunition will destroy the thing, right?

Therefore, it can't be an AOW.  "Such term shall not include a pistol or a revolver having a rifled bore, or rifled bores, or weapons designed, made, or intended to be fired from the shoulder and not capable of firing fixed ammunition."

MG fine, SBR fine, AOW fine, but all of those are NFA.

No DD involved.

Since they said "SBR", it must mean that pistol AR lowers are GTG with it.

But they don't have a fixed plug last I heard, so you could theoretically pull the plug and shoot it.  That would be their argument.

I wouldn't take the ATFs rulings too serious anymore. Between the SCOTUS word definition games and ATF flip flopping, it's best to just take anything they say like you would as if it's coming from your senile drunk 75y/o uncle.

If the lower is registered as an AOW, sure.   They covered that, too.

Though we should probably wait for them to publish the actual opinion letter.
