UPDATE:

Quoted:
So an update:

He was initially stopped by police responding to a call that a man was walking along the road with a gun. He did not say it was a farmer's access road or not. However, I would imagine he'd of been given the chance to leave the property if he was trespassing. What follows is the part that is unclear as he said he was then arrested after being stopped by the officer.

The update is that his son videoed the ordeal. But the lawyer doesn't want to release it yet.

Update: I got to watch the video. I can vouch for a few things:

1) He was not on private property but on the shoulder of a public county road in Temple,
2) He was not aggressive towards the office and complied with every order
3) He was stopped for the sole reason of open carrying an AR-15 style rifle after someone called the police.
4) He was not brandishing it or otherwise violating Sec. 42.01. DISORDERLY CONDUCT. According to the TX HTF says this

(a) A person commits an offense if he intentionally or knowingly: (8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm

There is a good bit of talk between CJ and two officers (one is the sergeant) and again there, he doesn't get belligerent nor hostile. He asserts his legal right to carry his firearm and actually gets the police to say some rather concerning things about how they feel about people who carry firearms. On that he asked me not to release the information but suffice to say to us non-tinfoilers it makes me want to put on a whole Reynolds wrap roll.

Now he has a page for his legal funds on indiegogo.

He claims that he was helping his son with his Eagle Scout training. He was disarmed and arrested sometime in the process of doing that.

Removed fundraising link... get permission from Striker to post it...krp

I haven't searched much but from his blog on that page… there's not a lot of details on what went down.

I am an active duty Soldier and veteran of Iraq and Afghanistan.  I'm a concealed handgun license holder in several states.  I have never in my life been charged with a crime.  I live in the country and love to shoot.  I strongly believe in the Constitution and the rights guaranteed by it.

While out hiking with my son through back country roads to help him earn his Eagle Scout rank, I was illegally arrested and disarmed without cause. I was thrown in jail and my lawfully owned weapons were confiscated without receipt or notice.

This shouldn't happen in the United States of America, much less the State of Texas.

I'd like to know the whole story of what happened and why he says his arrest was illegal.

One thing I've learned from reading news stories at arfcom is that … there often is more to a story.  And the "more" doesn't always support the original story headline etc.

More than likely was shooting from the 'back country roads' he was walking on, into someone elses property, and got busted.  Just a hunch.

There ia definitely more to this story.

I am seriously suspicious of a lawyer that only has a gmail account and a website that an amatuer could make in about 20minutes with basic tools that needs a $10,000 retainer for a case with no publicity.

He's not saying anything other than what you already read. I dropped a line earlier when this made Facebook but I got nothing.

You'll hear some more crap come out about him when Michael Yon heard about this. He and CJ hate each other because CJ has called Yon out numerous times and Yon then went butthurt on this last trip to Afghanistan. Yon said the CJ was out to kill him. I'd ask all to have a strong sense of WTF when Yon starts talking about this

ETA: Didnt see that the site did not have the charge of "trespassing". Which sounds like they might of walked on some farmer's road.

Trespassing armed in Texas is a felony.

Maybe he and his son can do an Eagle Scout project on personal property rights.

Not sure if that's the actual charge or not yet. So far he says he was just charged with resisting arrest/transport. But what starts that particular ball rolling in Texas could be a myriad of things.

There was no receipt or any other discussion about getting his weapons back. In fact the actions on the part of the officers contradict what the first officer said to him early in the stop.

You never get to hear the officer nor his supervisor say what CJ is being arrested for despite NUMEROUS pleas for them to say why he's being arrested. As for disorderly conduct, there is none I can see. He spends the whole video in handcuffs. The initial stop was only for carrying a rifle. The conversation between CJ and the officer describes what led up to the detention and I can say, based on the officer's careful responses (after understanding he's being recorded) I lean towards CJ's side when he explains he complied.

Temple Daily News article just sent to by CJ that includes Temple PD statement:

Weapons confiscated: Man, charged with resisting arrest, wants his guns back
BY DEBORAH MCKEON | TELEGRAM STAFF
Sunday, Mar 24, 2013 4:30 AM
A U.S. Army counterintelligence agent wants Temple Police to return the rifle and handgun they confiscated from him.

Temple Police stopped Master Sgt. Christopher J. Grisham, 39, disarmed him and then arrested him, his attorney, Kurt Glass, said.

Officers are claiming Grisham, who was on a Boy Scout walk with his son, resisted arrest, according to a police report issued by spokesman Cpl. Christopher Wilcox.

Grisham was arrested March 16 and taken to Bell County Jail. He was released later that day on a $2,500 personal bond, Bell County Sheriff’s chief deputy Chuck Cox said.

“Yes, Master Sgt. Grisham was arrested and it is our understanding he has been charged with resisting arrest, search or transportation,” Glass said Friday. “We are still gathering evidence and we are in the beginning stages of our investigation. We can confirm Grisham was carrying an AR 15-style rifle.”

Grisham had appeared before the Temple City Council on March 11, urging them to declare that citizen rights to keep and bear arms will not be infringed upon.

Glass said he is seeking the return of Grisham’s property. Grisham serves as a counter-intelligence agent for the U.S. Army at Fort Hood, he said. Among other things, including the weapons, police haven’t returned his concealed handgun license and it’s not on an inventory list supplied by Temple Police, Glass said.

“So some of his property isn’t accounted for yet,” Glass said.

Officers were sent to a report of two suspicious males in the area of Airport Road and Old Howard Road, Wilcox reported. The caller said the two were walking beside the road and one appeared to be armed.

An officer found Grisham and his son near the 7000 block of Prairie View Road and saw a rifle across one man’s chest with a magazine inserted and loaded. Instead of talking to Grisham first, the officer decided to disarm him, according to the police report issued to the Telegram.

The officer said Grisham was angry and irate, yelling at him that he wouldn’t give up his gun, yet he reached to take it from Grisham. The report also said Grisham tried to pull it away, making it hard for the officer to control the gun and him. At that point, the officer reportedly drew his weapon and pointed it at Grisham.

The report said the officer finally gained control of the situation and Grisham and held him against the front of his patrol car until help arrived. The report said Grisham passively resisted their attempts to handcuff him. Officers then found an additional weapon under his shirt at his waist.

Grisham had a valid Texas concealed weapons permit, the police report said.

Grisham and his son were on a Boy Scout hike to fulfill a task for a Scout rank requirement, Glass said.

So what underlying crime was he arrested for, by which he resisted arrest?

You can't just circularly arrest someone for no reason, then claim he was arrested for resisting the arrest.

Since there is no handgun open carry, I do no believe officers have any training on how to deal with situation.  In Texas is considerd resisting arrest or dentition.  I don't see we're there was a reason to detain the guy either. I really believe it boils dawn to untrained officer.

No opinion until I see the video. Seems to me, if the story being told is correct the video being released to the public could likely put an end to this whole thing rather quickly. Public outcry, especially if the officers words are that bad, could go a long way in raising funds and influencing an elected DA.

Interesting how so many people tell us that police won't obey orders to confiscate guns from otherwise law abiding citizens... or that it's only urban big-city cops who have a problem with guns... all the while it's becoming increasingly difficult to keep police (even in rural areas) from confiscating completely legal guns from people who are breaking no laws at all.
