I try to avoid Seattle at all cost, but if Nickles thinks his stupid little decision will stop me from carrying where he says I can't, he is sadly mistaken. The AG already said his previous attempt was unlawful so I fail to see how this is legal. Even if they decided this proposal is legal, I carry concealed, so the only way they will know I am carrying is when the cops arrive after a justified self defense shooting. I would rather take my chances in court than be dead.

You know... I applaude Mayor Nickles... in the sense that yeah, he's an idiot and he his fighting to take away our rights.... BUT, amidst having full well knowledge that what he is attempting to do is illegal, he still pushes and tries to make the way he thinks things should be into the minds of the citizens that don't know any different. I feel that if each of us pushed as hard as this guy is trying that we would have a common realization of our rights amongst the general population.

By Seattle Times staff A ban on guns in certain Seattle park facilities, specifically to protect children, went into effect today, according to the mayor's office. The move, which has drawn criticism including questions about its legality, affects hundreds of playgrounds, community centers, sports fields, swimming pools and water-play areas. "When children and families visit a Seattle Parks and Recreation pool, playground, community center or other facility, they are entitled to a reasonable expectation of safety," Mayor Greg Nickels said in a news release. "It's common sense to prohibit guns in places where kids and young adults play and learn." The gun ban, a new rule by Parks and Recreation, will be in effect only at facilities where signs have been posted, according to to the news release. Community centers will get the first signs, followed by pools, popular play areas, and ballfields. The mayor's office said all facilities should have the signs by Dec. 1. The first signs are expected to go up Friday at South Park Community Center, Garfield Community Center and Bitter Lake Community Center If someone with a gun enters one of the designated facilities, he or she will be asked by parks employees or Seattle police officers to leave. If the person won't leave, he or she could be cited or arrested for criminal trespass, according to the mayor's office. Nickels has argued that state law does not prohibit a property owner from imposing conditions on possessing firearms on his or her property. The city's position, Nickels has said, is that a municipal property owner such as Seattle may impose limits on firearms as a condition of entry or use of particular facilities, particularly those where children and youths are likely to be. State Attorney General Rob McKenna, however, has disagreed. In a statement released in mid-September, he said he has a history of working to protect children's safety, but "as Mayor Nickels is aware, the Attorney General's Office issued an opinion in 2008, which found that state law pre-empts local authority to adopt firearms regulations, unless specifically authorized by law." The opinion won't stop Nickels from invoking his ban, said Janelle Guthrie, with the AG's office. I've been emailing back and forth with Dave Workman at the Second Amendment Foundation as I was willing to participate in an act of civil disobedience if needed but wanted to check with them first so as not to mess up anything they had in the works.
Mr. Workman assured me that the SAF is working with NRA-ILA and that they have a plan in place. He asked that no one take individual action and said that the best thing any of us can do to help with the fight is to make a donation to the SAF. All donations are tax deductible. |

WA gun owners preparing to challenge Nickels ban October 19, 1:32 PMSeattle Gun Rights ExaminerDave Workman Gun rights activists are chomping at the bit to challenge the illegal gun ban imposed by Mayor Greg Nickels and the Seattle Parks and Recreation Department on park facilities in the city. Attorney General Rob McKenna has stated that this ban is illegal. Rich O’Neill, president of the Seattle Police Guild, told this reporter that he believes the ban to be invalid and “totally worthless.” And right now, the Bellevue-based Second Amendment Foundation and Citizens Committee for the Right to Keep and Bear Arms, and the National Rifle Association are said to be working out some last-minute details on the long-promised legal challenge. Based on their history in New Orleans and San Francisco, when these organizations join forces, the gloves come off and the other side loses...with bruises. Open carry activists seem the most impatient, as demonstrated by chat threads on the OpenCarry.org forum here, here and here. They are also planning a strategy session. Patience is a virtue. Waiting a few days is giving some important opinion leaders time to comment, and their sentiments are leaning strongly against Nickels. "His parting gift as the exiting mayor will be taxpayers footing the bill for what could be a host of lawsuits challenging his ill-advised and illegal gun ban." – Ken Schram, KOMO TV Recall the other day when KOMO’s Ken Schram weighed in, predicting that Nickels has just picked a fight that he will not be around to lose. And in the Seattle Weekly’s "Daily Weekly" blog spot, writer Caleb Hannan has second thoughts on the gun ban, also predicting that it is a loser that is going to cost Seattle taxpayers a lot of money. It is already costing them a lot of money. How much did the new gun ban signs cost? How many man-hours are being invested in posting those signs at some 500 city parks and recreation facilities? How much police time is going to be spent responding to “man with a gun” calls at these facilities that officers will be, in O’Neill’s opinion, “very reluctant” to answer? Here’s a suggestion: Greg Nickels, and maybe only Greg Nickels, should be held personally responsible for every penny. "Malfeasance is the doing of an act which an officer had no legal right to do at all and that when an officer, through ignorance, inattention, or malice, does that which they have no legal right to do at all, or acts without any authority whatsoever, or exceeds, ignores, or abuses their powers, they are guilty of malfeasance." – West Virginia Supreme Court of Appeals This is not an issue in which a well-intentioned public official makes an honest error while trying to do the right thing. This is a case in which a lame-duck mayor is going against an opinion from the State Attorney General. It is a case where a vehemently anti-gun public official is using his final days in office to create a legal quagmire that – despite his lofty opinion to the contrary – knowingly places the city he served on a collision course with a 26-year-old state preemption statute, and quite possibly Article 1, Section 24 of the State Constitution. If that does not stack up to the definition of malfeasancein office, it must come awfully close. It smacks of malice. Greg Nickels will be gone soon, but he is leaving a legacy of sorts that his successor will have to deal with, along with the citizens he once served and who have now turned him out of office. |

Will gun ban debate backfire on McGinn? The flashpoint in Seattle's mayoral race has switched from the Alaskan Way Viaduct tunnel replacement to Mayor Nickels' new gun ban on municipal property. At Sunday night's KIRO-TV debate candidates Joe Mallahan and Mike McGinn clashed over robocalls McGinn's campaign is placing that accuse Mallahan of "siding with the NRA" because he doesn't fully support the gun ban. Not surprisingly, Mallahan objected to McGinn's tactics. The Seattle Times reported on this debate exchange: "Mike and his campaign chose to conduct a lie campaign," said Mallahan, adding that his wife received one of the calls. "Mike, the Seattle voters deserve an apology. I deserve an apology." When asked if he would defend in court the ban enacted by Mayor Greg Nickels, Mallahan said he may not, because it is "not a pragmatic way of addressing public-safety concerns." "I don't owe an apology, because we told the public that Mr. Mallahan did not support the gun ban, and you heard that right now, here, he doesn't," McGinn said. Just as defeated incumbent Greg Nickels' last-minute attacks against Mallahan and McGinn helped boost their candidacies late in the primary, McGinn's gun robo calls could backfire on him. First off, nobody likes getting robocalls. Then there's the substance. Mallahan, the T-Mobile vice president, has labored to come off as the level headed pragmatist to McGinn's dreamy idealist. In uncertain times, Mallahan is hoping Seattle voters will opt for a pragmatist. Nickels' gun ban - which consists of signs posted on city property informing people of the weapons prohibition - will be challenged in court and the city will almost certainly lose. State Attorney General Rob McKenna says it is illegal - cities lack the authority to ban guns because local laws would conflict with state regulations. It will cost real money for the city to defend the ban. In his 2008 report, City Attorney Tom Carr said civil division attorneys provided more than 84,000 hours of legal service to the city, costing about $5.8 million. Carr said that worked out to be about $70 per hour - not bad at all for legal fees. But even at $70 an hour defending the gun ban will take money away from other areas at a time Seattle is facing a $72 million operating budget. Mallahan would argue that $70 an hour could be better spent elsewhere. We'll see how many Seattle voters agree with him. |

BELLEVUE, WA – The Second Amendment Foundation, National Rifle Association and five local residents today filed a lawsuit challenging a new Seattle parks regulation that bans firearms, arguing that the ban violates Washington State’s long-standing preemption statute. They are joined by the Citize ns Committee for the Right to Keep and Bear Arms and the Washington Arms Collectors. The lawsuit was filed in King County Superior Court names the City of Seattle, Mayor Greg Nickels and Timothy Gallagher, superintendent of Parks and Recreation, as defendants. Plaintiffs are represented by Seattle attorney Steve Fogg with the Seattle law firm of Corr, Cronin, Michelson, Baumgardner & Preece LLC. “This ban violates Washington’s 26-year-old model preemption statute,” noted SAF Executive Vice President Alan M. Gottlieb. “The ban makes it impossible, under threat of criminal trespass penalty, to lawfully carry firearms for the protection of spouses, partners and children on public property where these citizens have a right to be. We are once again delighted to be joined by the NRA in this action. Our successful collaborations in the past stopped illegal gun confiscations in New Orleans following Hurricane Katrina, and nullified an illegal gun ban in the City of San Francisco.” Individual plaintiffs in the case are: Winnie Chan, a Department of Corrections employee who lives in Seattle and works in West Seattle. When she is not on-duty, she often carries her personal concealed handgun, particularly when she is going to be in unfamiliar locations, out late at night, or in large/crowded places. (DOC policy prohibits her from carrying her state-issued firearm when she is off-duty, and therefore she owns a personal firearm.) She is concerned that people she has encountered on the job may be disgruntled and pose a threat to her safety. She sometimes visits Lincoln Park for recreation, and she has seen a sign prohibiting firearms there. Ray Carter, also a West Seattle resident employed as a car salesman at MC Electric Vehicles in Seattle. He is active in the gay community; he co-chaired the Pride Parade in the mid-1990s and founded the Seattle Chapter of Pink Pistols/Cease Fear. He has testified in Olympia and at City Hall regarding gun bans. The /Seattle Weekly/ wrote an article about Ray in June 2000 entitled “Gays and Guns.” He carries his concealed pistol any place w here it is legal, and he believes this is necessary because he is susceptible to hate-related crimes. Ray sometimes visits Lincoln Park and Alki Beach, and he states that he has seen signs prohibiting firearms at those locations. Gary Goedecke, owner and proprietor of Pikeplace Marketwear, a 35-year old business at Pike Place Market. A Bothell resident, he has been actively involved with the Pike Place Market for years. Gary is an avid gun owner and carries a concealed pistol wherever he can. Gary notes that Steinbrook Park is directly adjacent to the Market and is a very dangerous place; he fears for the safety of his wife (who also works at the Market) and his employees. Gray Peterson of Lynnwood, who often visits Seattle parks facilities with his domestic partner. Active in the Seattle-area gay community, Peterson is licensed to carry a concealed firearm and does so where it is lawfully permitted because of concerns that he is susceptible to becoming a victim of hate-related crimes. Signs have been posted at some of his favorite parks that prohibit firearms possession. Robert Kennar, a Department of Corrections employee and resident of Federal Way. He frequently works in Seattle and visits parks and recreation facilities. Kennar has been a crime victim and he often observes criminal activity in Seattle. He is licensed to carry a concealed handgun and always carries his personal firearm when not on duty where he is permitted to do so. He is concerned about retaliation from people he encounters in his line of work. Kennar enjoys visiting Seattle parks, but one of his favorite parks now displays a sign prohibiting firearms. “This ban affects the rights of all Washington citizens who may visit Seattle parks property and recreation facilities, and especially thousands of Seattle gun owners, many of whom are members of both organizations,” Gottlieb stated. “It essentially impairs the right of law-abiding citizens to bear arms for personal protection, which is explicitly protected by Article 1, Section 24 of the state constitution.” Washington State Attorney General Rob McKenna has issued an opinion that the ban is illegal. Under provisions of the ban, legally-armed citizens face arrest for criminal trespass if they enter park property. “The parks ban is a going-away gift of sour grapes from ousted Mayor Greg Nickels to the citizens of Seattle,” Gottlieb observed. “He is leaving a mess for his successor, and the taxpayers who rej ected his third term bid, to clean up.” |

SAF, NRA file lawsuit to overturn Seattle parks gun ban
October 28, 12:24 PMSeattle Gun Rights ExaminerDave Workman This morning, the Second Amendment Foundation, National Rifle Association and other gun rights organizations, and five individual citizens filed the long-awaited lawsuit against the City of Seattle and Mayor Greg Nickels that seeks to nullify the city’s ban on firearms from parks and recreation facilities. The city had been warned months ago that if the mayor went ahead with his plans to defy state preemption, the lawsuit would be coming. The outgoing mayor, who will leave office at the end of this year, was advised in late September by the Attorney General’s office that such a ban would violate Washington’s long-standing preemption statute that places sole authority for firearms regulation in the hands of the Legislature. This law has been on the books for more than two decades and has served as a model for laws in other states. Joining in the lawsuit are the Citizens Committee for the Right to Keep and Bear Arms and the Washington Arms Collectors. They include: Winnie Chan, a Department of Corrections employee who lives and works in West Seattle. When she is not on-duty, she often carries her personal concealed handgun, particularly when she is going to be in unfamiliar locations, out late at night, or in large/crowded places. The DOC prohibits her from carrying her state-issued firearm when she is off-duty, so she carries a personal firearm. She is concerned that people she has encountered on the job may be disgruntled and pose a threat to her safety. Likewise, Robert Kennar, who also works for DOC and occasionally visits Seattle parks and recreation facilities. He frequently works in Seattle and he has been a crime victim. He is licensed to carry a concealed handgun and always carries his personal firearm when not on duty. Ray Carter, a West Seattle resident employed as a car salesman in Seattle is active in the gay community. He co-chaired the Pride Parade in the mid-1990s and founded the Seattle Chapter of Pink Pistols/Cease Fear. Licensed to carry, he frequently visits parks to enjoy the out-of-doors. " This ban affects the rights of all Washington citizens who may visit Seattle parks property and recreation facilities, and especially thousands of Seattle gun owners, many of whom are members of both organizations. It essentially impairs the right of law-abiding citizens to bear arms for personal protection, which is explicitly protected by Article 1, Section 24 of the state constitution.” – Alan Gottlieb, Second Amendment Foundation" Gray Peterson of Lynnwood, who often visits Seattle parks facilities with his domestic partner. Active in the Seattle-area gay community, Peterson is licensed to carry and does so where it is legal because of concerns that he is vulnerable to hate-related crimes. Gary Goedecke, owner and proprietor of Pikeplace Marketwear, a 35-year old business at Pike Place Market. A Bothell resident, he has been actively involved with the Pike Place Market for years. He is an avid gun owner and carries a concealed pistol wherever he can. Steinbrook Park is directly adjacent to the Market and is a very dangerous place; he fears for the safety of his wife (who also works at the Market) and his employees. The lawsuit, filed in King County Superior Court names the City of Seattle, Mayor Greg Nickels and Timothy Gallagher, superintendent of Parks and Recreation, as defendants. Among those filing the suit are the Second Amendment Foundation, the National Rifle Association, Citizens Committee for the Right to Keep and Bear Arms and the Washington Arms Collectors. "Every time the anti-gunners want to push gun control, they say we are doing this for the children," said Alan Gottlieb with the Second Amendment Foundation. "It's almost like it's their lead banner every single time, no matter what." They say the ban violates Washington State's long-standing preemption statute. "The ban makes it impossible, under threat of criminal trespass penalty, to lawfully carry firearms for the protection of spouses, partners and children on public property where these citizens have a right to be," he said. But there was some support for the ban at Green Lake. "I don't know why anyone needs a gun at a playground or any place where there are kids around," said Brain Nevenhouse. But for others, they say the need for protection is everywhere. One of those party to the suit is Bob Kennar who supervises parolees for the state. He carries his own gun, because some of the bad guys don't like him. "It's in the back of my mind," Kennar said. "I don't lose sleep over it, but like the police I know there's a chance that could happen." Kennar has carried a gun for 29 years. He says the city of Seattle can't tell him no. Ray Carter is gay. Seattle officials say anyone who enters one of the posted facilities with a gun will be asked by Parks personnel or Seattle police officers to leave the area. If they refuse, they could be cited or arrested by police for trespassing. After a man shot and injured three people at the 2008 Folklife Festival, Seattle Mayor Greg Nickels directed city departments to evaluate rules, policies and leases related to guns. The suspect in last year's shooting had a concealed weapons permit and a history of mental health problems. The rule won't go into effect at a specific facility until signs are posted outside notifying people of the gun ban. The signs will be posted in phases with all signs in place by Dec. 1. Kent man to challenge Seattle gun banA Kent man has announced that he intends to carry a pistol into a West Seattle community center on Saturday to trigger a lawsuit challenging Seattle's ban on guns in public spaces. Bob Warden, 44, announced his intentions in an e-mail Friday morning to media as well as to the City of Seattle, including the police and city attorney. "As a courtesy, this is advance notice that at noon tomorrow, Saturday, November 14, I plan to exercise my legal right to bear arms in Seattle's Southwest Community Center, 2801 SW Thistle Street," Warden said in his e-mail. "I will be safely and securely carrying my holstered Glock pistol. I have a current valid State of Washington License to Carry Concealed." He also described the Tacoma Rainiers baseball cap he will be wearing so that he can be spotted. Seattle parks officials have not yet responded to a request for comment. "I'm not looking for any trouble," Warden said in an interview. He said he will comply with whatever instructions police or parks officials give him. But whether he is turned away or cited for trespassing, Warden said the incident should give him standing to sue to challenge the ban. Seattle Mayor Greg Nickels said on Oct. 14 that guns would be banned on such city facilities as parks and community centers where children gather. Signs banning guns have been posted at city parks. Late last month, gun-rights advocates sued, saying the ban violates state law. But Warden, a licensed attorney in the state, says he worries that the earlier lawsuit may be thrown out because those who filed it lack legal standing. Warden said he does not actively practice law. He said he works in labor relations for the federal government but would not describe his job further. He said he is taking the action because he believes the ban is illegal. He noted that the state Attorney General's Office has said so. "They know full well it's illegal, but they went ahead and did it anyway," Warden said. Warden described himself as a political independent, but a man who has probably voted for only two Republicans in his life. He said he is not a member of the National Rifle Association, but was certified by that organization as a pistol instructor. He said he uses the certification in his volunteer work with the Boy Scouts. |

SAF/NRA case against Seattle gun ban moves forward If everything goes according to current schedule, attorneys for the Second Amendment Foundation and National Rifle Association will be in court on Feb. 19, 2010 for what they hope will be a smack-down of Seattle’s gun ban in city parks and recreation facilities. The case will go before King County Superior Court Judge Greg Canova. Currently in the “discovery” phase, according to Seattle attorney Steve Fogg, who represents SAF, NRA, the Citizens Committee for the Right to Keep and Bear Arms, Washington Arms Collectors and five local residents, the lawsuit is on schedule and he believes the case is solid. Two key plaintiffs have had encounters that clearly erase any doubts about “standing” and one of those incidents belongs in the “You’re Not Going to Believe This!” realm. Last month, Seattleite Ray Carter visited the Alki Community Center packing a pistol and he was promptly asked to leave. Carter requested an explanation about why he was being booted, and he got one…in writing. The note, signed by Jamieka S. Muldrow, is one of those “Exhibit A”-type documents that leave gun rights advocates rolling their eyes. This letter is informing you that you are instructed to and must depart City of Seattle Alki Community Center campus due to the fact you are lawfully carrying a fire-arm (sic) that is licensed to you. You are in violation of the City Parks policy and will not be permitted on City Parks and Recreation grounds; Regardless of any provisions in the RCW to the country (sic), while carrying a firearm. Due to the City of Seattle strict rules and policies we have to inform you that you are restricted from City of Seattle Parks and Recreation grounds. Carter said he stood by politely while Ms. Muldrow wrote the note. There were no television cameras hovering around, Carter was not trying to make this a media event, and the note is now in the hands of the SAF/NRA legal team. One is compelled to wonder what kind of note would be handed to a thug who is unlawfully “carrying a fire-arm” that is not “licensed” to anyone, since it would probably be stolen property. (Hint: Firearms are not licensed in Washington State. They never have been. Criminals don’t bother with concealed pistol licenses anyway.) Carter’s fellow plaintiff, Gary Goedecke – a Pike Place businessman – was advised by a Seattle police officer not to enter Steinbrueck Park because he was legally carrying a pistol. The officer told him that firearms are not allowed in the park. A separate challenge to the Seattle parks gun ban has been filed in federal court. Plaintiff Bob Warden of Kent, a licensed attorney, is serving as his own counsel in that case, which has no connection to the SAF/NRA case. SAF and NRA filed their case in Superior Court about two weeks prior to the federal challenge. Superior Court is probably where this case belongs, since it involves a regulation that appears to clearly be in violation of a state statute, and Article 1, Section 24 of the state constitution, which provides that “The right of the individual citizen to bear arms in defense of himself, or the state, shall not be impaired...” Washington adopted the original state preemption law in 1983 and strengthened it in 1985. It has served as a model for similar laws in several other states. Naveed Haq conviction long overdue Naveed Haq, the self-styled “martyr for Islam” who forced his way at gunpoint into the Seattle Jewish Federation offices three years ago and then opened fire, will spend the rest of his life in prison following Tuesday’s guilty verdict in his second trial. The first trial ended with a hung jury in 2008. But at least Haq will not be getting any time off for good behavior. His violent hate crime will keep him locked up for good. Watch anti-gunners use the Haq case to launch a new campaign to attack Washington State’s gun laws as being too weak. Wait for gun prohibitionists to exploit this case to campaign for tighter restrictions on gun shows, even though Haq didn’t buy his guns at gun shows. He bought the handguns at retail gun shops in the Tri-Cities area in the weeks before his carefully-planned attack that took the life of Federation campaign director Pamela Waechter and left five other women wounded. Haq passed background checks, same as did Virginia Tech gunman Sueng Hui-Cho. Virginia tightened up its statute as a result of the Virginia Tech massacre. So what? Haq had bought three firearms in the days before the shooting. While he had spent time in several mental hospitals, Haq declined to note those hospitalizations on background check questionnaires and was able to buy the guns by legal means.––Seattle Post-Intelligencer As we saw in the recent case of Parkland cop killer Maurice Clemmons, a convicted felon who was given a break by former Arkansas Gov. Mike Huckabee, even people who cannot legally own firearms will get them despite every legal roadblock. Such roadblocks really only impact honest citizens. Clemmons should not have had a gun, yet he had two and took a third from one of the officers he killed, and was evidently preparing to use that gun to kill a fifth cop in Seattle, who was fortunately a little quicker on the trigger. Naveed Haq, Sueng Hui-Cho and Maurice Clemmons prove that gun control laws do not stop bad people from doing very bad things. Pushing for even more stringent firearms prohibitions in the wake of such crimes will not undo the crimes already committed, or prevent the next Clemmons, Cho or Haq from violating existing laws against murder and mayhem.
