I've got a form 1 pending (e-filed 4/15), which I hope will be approved in about 2 weeks. BCM now has 11.5" ELW back in stock as of today. With my luck they'll go OOS a day before my stamp is approved.

There are several legal ways to comply with/avoid constructive possession.

I've got the 11.5LW with KMR.
Absolutely love it.

I had that problem. Got my stamp 2-3 weeks ago and the 11.5's finally came in stock today

Just order it and wait until you get your stamp to put it together. It isn't hard to practice some self control. Keep it at work, a friend's, a relative's, etc.

See if BCM will let you buy it but delay shipping until your stamp comes in.

With the price of lowers today I don't know why anyone wouldn't always keep a pistol lower on hand.
Couldn't you also take the lower that was Form 1 and make it a pistol? Then when you are approved it becomes a rifle.

Buy the parts and leave it in the box unopened. Don't get cute, but constructive possession is for all intents and purposes a myth.
By the time it is getting applied, you're already going to jail for something else.

I'm keeping a pistol tube on my pending SBR. It's legally a pistol right now. Without a pistol lower though, just having the upper or barrel would be seen as constructive intent.

Also, if you have the upper - not assembled on the lower - and a pending Form 1... The "constructive intent" is to comply with NFA.
Is your lower engraved? Might take the opportunity now to have it engraved.
