I send them an email regarding the purchase of a no-ban upper and got this reply:

"Dear Valued MidwayUSA Customer,

Thank you for your recent email inquiry. At this time we do not carry any pre-ban uppers for an AR-15 with bayonet lug and flash hider. We are sorry for any inconvenience this has caused you. These have been illegal to manufacture since the ban was put in effect in 1994. Now that the ban has been lifted, we expect to see production of these items begin, however, they will probably not be available for at least several months up to a year.

So you sent Brownell's an email and MidwayUSA replied? Interesting..

BTW, Brownells sells threaded barrels with bayonet lugs, I'm assuming you wrote the wrong thing in the topic line.

Hate t otell you but they do sell the no ban uppers, DPMS to be exact and they are, or were in stock.

Brownells Catalog #57 has some preban uppers listed currently

These are suppliers, distributors, not manufacturers. They have to sell their current stock. Now, if customers start going elsewhere, they may be forced to take a loss on these "post ban" models. Watch the prices.
