MILWAUKEE — Two home improvements stores are accused of deceiving the buyers of four-by-four boards, the big brother to the ubiquitous two-by-four.
The alleged deception: Menards and Home Depot (HD) market and sell the hefty lumber as four-by-fours without specifying that the boards actually measure 3½ inches by 3½ inches.
The lawsuits against the retailers would-be class actions, filed within
five days of each other in federal court for the Northern District of
Illinois. Attorneys from the same Chicago law firm represent the
plaintiffs in both cases. Each suit seeks more than $5 million.
“Defendant has received significant profits from its false marketing and sale of
its dimensional lumber products,” the action against Menards contends.

I've bought lumber in CA recently and they were marked 2x4, 4x4, etc (i.e. correctly)

It has happened a few times over the last 100+ years, the key is, "Dimensional Lumber"  the rough product starts out at the actual dimension, then is milled to industry standard, which is 3.5 x 3.5 or 1.5 x 3.5, it is the basis for all the building that has been done in this country for well over 100 years.  HD and Menards has not derived any extra profits because they advertise and sell what the industry standard are based on and milled to.

All the parts for building are based on this standard, to change everything this many years later is cost prohibitive and has been the basis for many of these lawsuits being overturned in the past.

One upshot of the settlement is the intention of Lowe’s to include the actual product dimensions of 2x4 lumber (1.5 inches by 3.5 inches) along with the description of the product as a “2x4.”

The suit arose from a civil enforcement action filed by district attorneys of several California counties.

"Consumers should expect when making product purchases that retailers are providing accurate information especially when misinformation could adversely affect building projects that more often than not rely on precise measurements," said District Attorney Ed Berberian.

I only buy my lumber green, from the guy with the Harbor Freight saw mill.  That way I know my 2x4s are really 2inches by 4 inches. Never mind my walls have gaps from shrinkage and what not.

This is what is so damn idiotic...

It was almost 20 years ago that I took business law in college but industry standards were one of those topics that were along the lines of "hey if you are going to be in industry know the terminology".

The exact issue of 2x4s being an example.

Whatever. It's still stupid. Wood dimensions are fucked. I think it's weird people like it. Just because it's been done that way for 100 years doesn't mean it's a good way. 

If I get a piece of flat stock it's the size it says it is. I like metal.
