I think road beers should be legalized. Here is why:

If I want to relax with a beer, a short time after work - I have one option. Go to a bar. Now, in the bar you can have your one beer... and feel the full effects while you are on the road.

--or--

I propose that the 'road beer' be authorized if you are under legal BAC limits. Here is the math, from me-

I will consume this beverage over the course of a commute (in my case, 45 minutes). Now... the full effects of said beer won't be realized until I have arrived at my destination (for all intents and purposes).

I deduce that, a 'road beer' results in a safer motoring experience without the possibility of an old friend showing up... resulting in staying at the bar a little longer than you should... or something like that.

I am, in before the poll.

I don't know about it being illegal, but it is just a plain bad old idea to be drinking, eating, texting, talking on phones and all that while driving. Even if not drunk it can distract your driving if you are drinking and it can place you in the position where you can harm others.

Any open container alcohol has no place in a vehicle.

Why people argue it is always beyond me.

I still think there should be a lower tolerance for DWI, but that's another thread. If you want to drive, don't drink before or during.

So, let me get this straight - you prefer I have a 16oz beer at the bar. Absorb it 100% on the way home.

BUT, not drink a 16oz beer on the way home and absorb 50% of it?

ETA: What I do not understand is why a passenger in a vehicle cannot have a drink so long as the driver is stone sober.

As it should be.  I actually agree with the OP, as long as you aren't legally impaired it should be allowed.  Open container laws are an anachronism from the days before breathalyzers existed.

Poll results disagree with all y'all.

Op I agree with you.  Unfortunately people are no where near responsible for that level of liberty.

If the driver isn't intoxicated than how is it more dangerous than sipping a bottle of water?

It is kosher in TN. According to a thread up a few - it is also legal in CT (of all places). MADD is hitting the state hard on our law... doubt it will be around by the end of the decade.

You don't have to be intoxicated to be impaired.
People get DUI's all the time even though they blow under the limit. They are deemed impaired by the officer and that usually is enough to get a conviction.
Why make it easier for the cop by having a tall boy in the cup holder?

When in wyoming heading to the mountains, i usually grab a six pack and make the sammich maker drive. legal there.  Its semi legal in sd to drink a beer and drive, hard to get busted when the cops are hundreds of miles away and your on some backroad

Ah yes, the hypocracy of GD. Fuck drunk drivers with a BAC with .08 (they got what they deserved) but it should be OK to drink while driving with a .079 BAC Come to Va where you can get a DUI even if you're not driving.

The problem is people would abuse it to the max. Not to say i've never drank a road soda in my time but that's rare and something like just cracked a beer and am a buddy down the street or in the neighborhood calls and says swing by. Not driving around out on the town etc

Not legal here anymore but it isn't a moving violation. You get to pay a tax if caught.

When I was younger I did it a few times and looking back I was a fucking idiot.

The minister of sex and finance was ticked and almost arrested for an open container violation here when we stopped to get gas and she was throwing out a grocery bag that had a few open beer cans in it. It didn't matter that they were warm and dry and were from when we went to the lake a few days before the officers didn't care.
She went before the judge and was asked what happened and when she looked at the paperwork about the case she saw it was from the cigarette cops she tossed the case and reamed the officers a new asshole

When I first moved to Texas from California in 78 we got invited to some people's house. The husband was a cop and he said he would show me around town, so we jumped into his cop car, stopped at the ice house to filled his ice chest with beer and then drove around town in a cop car drinking beer.  What a difference from California where you could not have alcohol in the passenger compartment, open or not.
