HB1935 passed yesterday eliminating all "illegal knife" wording from the books. Come September 1st no more arbitrary 5.5 inch law and no more double edge law.

I am glad that this passed. It is good to be able to carry weapons legally. 

That said, I highly doubt that this will impact anything. I still haven't seen two people open carrying handguns and that became legal two years ago.

With a legal right to carry a firearm, I never gave much thought to the knife laws here. The idea of catching a case for a blade while carrying a firearm made me chuckle. If it ever came down to it I would gladly take my case in front of a jury of my peers.

From the way I am reading the new amendments, they scratched out the illegal part and put the same restrictions on a >5.5" knife as a concealed handgun has without the licensing. Basically you can carry anywhere but where LTC's are prohibited. RIGHT??

He was in the right and the charge was dropped.

I think he had a fair case for false arrest.   The inability of any cop in particular to read/understand the law does not grant him probable cause to believe a crime is being or has been committed.

He carried a knife with a blade over 5.5 inches, a statutorily defined "illegal knife."   Cop confronted him about it.   He pointed out that the chl statute that exempts a person from the unlawful carry of a weapon statute for carrying a handgun does the same for an illegal knife.  

It doesn't specify one or the other.   Carrying an "illegal knife" was just as lawful as carrying a concealed handgun under the same law that carved out the chl exemption.  

Cop arrested him anyways.

My internet is shite right now so I won't bother to look up and copy/paste the relevant statutes.   This was covered ad nauseum back when it happened, anyways.

Can't carry 5.5+ in these places.  Also restricted if you are under 18.

(a-1)  A person commits an offense if the person

 license issued under Chapter 25, 28, 32, 69, or 74, Alcoholic
 Beverage Code, if the business derives 51 percent or more of its

 Beverage Commission under Section 104.06, Alcoholic Beverage Code;
              (2)  on the premises where a high school, collegiate,

 location-restricted knife is used in the event;
              (3)  on the premises of a correctional facility;
              (4)  on the premises of a hospital licensed under
 Chapter 241, Health and Safety Code, or on the premises of a nursing
 facility licensed under Chapter 242, Health and Safety Code, unless
 the person has written authorization of the hospital or nursing
 facility administration, as appropriate;
              (5)  on the premises of a mental hospital, as defined by
 Section 571.003, Health and Safety Code, unless the person has
 written authorization of the mental hospital administration;
              (6)  in an amusement park; or
              (7)  on the premises of a church, synagogue, or other
 established place of religious worship.

I have seen it a few times. But what "open carry" really means is that concealed carriers need never worry about printing or anything else. So long as the weapon is in a holster it is legal.

Thanks for posting that.  It looks like they used the original CHL law language.  Hopefully we can carve aware at those restricted locations, like we have done for the CHL rules.

For me, the most obvious benefit is if I'm out in the country hunting or carrying an openly holstered pistol for defense from predators, and I have to run into town, I don't have to pull the pistol out and leave it under the seat.  It's much safer in my holster.

I know there is a cutover period.  I think the law isn't fully implemented until 1/1/2018, on 9/1/2017 it is just finalized, but the statues don't change until the new year.  The period from september to january is for communication and dissemination of the changes from the legislative period.
