I appreciate your opinion but I think my very dark view of the GA justice system is more accurate and will prevail. At the top is Kemp. Kemp appoints judges. I don't have knowledge of how the appeals and supreme court have ruled in the past, but knowing who appoints the justices informs my opinion. The behaviors we agree on may very well be ignored and brushed away. Remember, racism only goes one way. It was Raffensperger who thought that signing the settlement codifying election cheating would keep voters from calling him a racist. But it sealed the fate of Republicans including Trump. And they still called him a racist. |

She was in Florida, where it is illegal to record a call without all parties consenting. She neither asked for, nor received, consent to record. Fani Willis, the Fulton County district attorney, can stay on the Trump election interference case in Georgia but only if she cuts ties with her prosecutor 'lover' Nathan Wade, a judge has dramatically ruled. In his 23-page ruling Superior Court Judge Scott McAfee slammed Willis for a 'tremendous lapse in judgment' and acting in an 'unprofessional manner' when she gave evidence in his court. Judge McAfee made the stunning comments as he considered whether Willis should be disqualified from the case she brought against Donald Trump and 18 codefendants. The judge ruled that her relationship with Wade did not amount to an 'actual conflict' of interest. But he went on: 'This finding is by no means an indication that the Court condones this tremendous lapse in judgment or the unprofessional manner of the District Attorney’s testimony during the evidentiary hearing.' He added that 'an odor of mendacity remains' in the case but the court was not 'under an obligation to ferret out every instance of potential dishonesty from each witness.' McAfee had self-imposed a deadline of this week to rule after holding bombshell hearings featuring testimony by Willis herself about her 'romantic' relationship with Wade. At issue in his decision was when the affair between the two prosecutors began, and whether it posed an actual conflict of interest or the appearance of one. The judge and clashing attorneys explored those issues in sensational hearings that featured angry testimony by Willis. She was confronted by defense lawyers and there was conflicting testimony about whether the couple were involved in a 'romantic' relationship before Wade joined her team in 2021. The hearings also featured details about cruises and luxury travel the pair engaged in – and whether it constituted any sort of improper benefit to Willis that allowed her to gain financially from the prosecution of Trump and his allies. In his ruling Judge McAfee said: 'The prosecution of this case cannot proceed until the State selects one of two options. 'The District Attorney may choose to step aside, along with the whole of her office. 'Alternatively, Wade can withdraw, allowing the District Attorney, the Defendants, and the public to move forward without his presence or remuneration distracting from and potentially compromising the merits of this case.' The judge stressed that 'no ruling of mine is ever gong to be based on politics.' He then sorted through whether Wade and Willis had an actual financial conflict. Judge McAfee wrote: ‘Whenever a private attorney - like Wade - is paid by the billable hour, a motive exists to extend or prolong the assignment. 'This, however, is a tension that the legal profession has long accepted.' His ruling goes through the various trips the pair took, including to Aruba and Napa Valley. But he found Willis did not get a ‘direct financial benefit’ from her decision to hire Wade. He also essentially accepted her claims that she reimbursed Wade in cash for expenses during their travels. ‘Such a reimbursement practice may be unusual and the lack of any documentary corroboration understandably concerning. 'Yet the testimony withstood direct contradiction, was corroborated by other evidence (for example, her payment of airfare for two on the 2022 Miami trip), and was not so incredible as to be inherently unbelievable. However, as the District Attorney herself acknowledged, no ledger exists. 'Other than a “best guesstimate,” there is no way to be certain that expenses were split completely evenly - and the District Attorney may well have received a net benefit of several hundred dollars.' From time to time there have been elections with disputes over who the real Electors are which is what motivated Congress to pass a law (which exceeded their constitutional authority, IMO, as does the newer replacement law) specifying which ones are to be considered valid and such (picking the Governor's appointees over the legislature's is rather unconstitutional as the legislature has the ultimate authority under the Constitution with respect to who the Electors are to be). Choosing to make an issue of it legally now is clearly politically motivated and you do not have to be a Trump supporter for that to be obvious (I cannot stand the man and want him completely gone from our politics). They do not explain how this lesson worked in terms of the space-time continuum. In any case, Fuchs recorded a phone call between Trump, Raffensperger, and their associates. Fuchs ended the call by saying they should get off the phone and work to “preserve the relationship” between the two offices. Instead, she immediately leaked the phone call to The Washington Post, which published it hours later. Covering up the Crime This is where the authors of the book admit that the very recording of the call was a crime: Fuchs has never talked publicly about her taping of the phone call; she learned, after the fact, that Florida where she was at the time is one of fifteen states that requires two-party consent for the taping of phone calls. A lawyer for Raffensperger’s office asked the January 6 committee not to call her as a witness for reasons the committee’s lawyers assumed were due to her potential legal exposure. The committee agreed. But when she was called before a Fulton County special grand jury convened by Fani Willis, she was granted immunity and confirmed the taping, according to three sources with direct knowledge of her testimony. Republicans had long suspected Fuchs was the source of the audiotaped call and, further, that she had illegally recorded it in Florida. Fuchs had noted in a Facebook post that she was in Florida visiting family around the time of the call. The book describes the close working relationship and “secret collaboration” of the Liz Cheney-led Jan. 6 committee and Fani Willis’ prosecutorial team. Fuchs should have been a major part of the televised show trial Cheney put on, further convincing Republicans that Fuchs had illegally taped the call and Cheney was helping cover that up. (Incidentally, the book portrays Cheney as the real leader of the Jan. 6 committee, that she viewed it as a “platform for her to resuscitate her political career” and would “provide a springboard for a Cheney presidential run.”) The authors go on to say Fuchs would attempt to escape prosecution for the call if a Florida official brought charges by claiming she taped and immediately leaked the call to The Washington Post for “law enforcement purposes.” The authors somewhat hilariously describe this claim as an “effective defense.” |
