For those who've not followed the unbelievable and ongoing saga:

Judge Astacio, a woman of color and urbanity, last year was convicted of DUI.

Subsequent to that she blew alcohol into her auto locking device, and had somebody else do it, thereby violating parole.    Furthermore, two photos of her partying and apparently consuming alcohol while on parole.

She wasn't jailed while waiting for the hearing.   In fact, at the hearing charges were dropped.

Then recently another incident where she blew alcohol into the interlock device.   She was ordered to have a chemical test and appear in court.

Now apparently she is on vacation in Thailand for several months!   There is a warrant for her arrest.

Yet still, somehow, she's avoided incarceration,  still holds her position, and is still drawing a $174,000 salary!


Do you think YOU would get so many breaks?    Wouldn't it be nice to be part of the immune elite?

I am an almost 55 year old white male of European descent. You got me at "convicted of a DUI" LOL. They would get me on just suspicion and forego conviction. I would not even be allowed to get to the interlock stage. Privilege indeed.

I suggest you drive wearing a brightly colored, short dress and makeup.   If pulled over, claim you are a tranny and you are being singled out as one of the underpriviledged.

She's claiming she's not on vacation but living with monks.


I'm betting she's never coming back.  First off, they haven't cut the paycheck off yet.  Sure sure, some news sources say that they "might" but... yeah, "might".  

Remember, the dollar goes pretty darn far in Tailand.  Even if they do eventually yank her paycheck, I'm sure she's already pulled a lot of money from her accounts already.  And if she's living with monks, I'm sure that's keeping her costs down too.


Essentially she has nothing to make her come back, short of trying to convince the Thai police to arrest her, or asking the monks to turn her out.  And I'm kinda doubting that'll happen.  (Bribes and all)

She's not on parole or even probation. She received a conditional discharge b/c of the ignition interlock device.  She's alleged to have violated a condition of the CD.  

It ain't easy to remove a judge--she was elected after all.

She has two children. She will come back. She faces a maximum of 1 year in jail...no prison. I doubt she would get anything even remotely close to that on her first offense on a misdemeanor dwi.

Thank you.  I was going to say both of these.

As for DUI while being white male, believe me, you (general 'you', not DeadHorse;  this was directed at previous posters) would be getting way too many breaks, too.  The system is way too easy on everyone.  And as a judge, you would still have your position, at this point.

Apparently, yesterday a letter was sent that if she misses a court appearance on Monday it would be considered job abandonment. As part of her conditional release she agreed to take any court ordered tests, then left for Thailand two days before she was supposed to take one. That is why the bench warrant was issued yesterday.

I have no doubt if it were me or any of you unannointed who blew alcohol into the lockout device and then had somebody else do it, we'd be in jail.    She got off because Fiandach gamed the system and the prosecutor screwed up.    And who wouldn't have been fired by now?   Anybody have a job they don't have to attend yet still get paid?

Only ones I know of are some politicians and other politically connected people who get paid by the taxpayers.  At least one is getting sentenced on June 20th in Suffolk County for having a no show job on the taxpayers dime.

She continues to collect her annual salary of $173,700.

Even if she is convicted of all charges, she will remain a paid judge unless the state Commission on Judicial Conduct removes her from her position.

I don't care whether the city of Rochester has to continue to pay for her salary.  They chose to elect her over a much better, more experienced candidate--now they have to live with the consequences.  After all, it isn't coming out of my pocket.

Now she fired her lawyer. I really hope she had an agreement with a new one before doing that. If I was a lawyer approached by her at this point, I wouldn't touch this case with a 10ft pole. I have some sympathy for Fiandach, he can claim he didn't know she was this nuts, anybody who takes it over now is just asking for it.

From what I understand, there is a judicial board and they are the only ones that can remove her. In one way I can understand not wanting it to be easy to remove someone elected by the people, lest it be used for political reasons, but at this point she has shown pure contempt for the law and the judicial system and she needs to be removed.
