Someone on the 9th circuit must have read a Mother Jones article or two.

As an aside, and just in case you didn't know, the same court, the same day, decided Baker v. Kealoha, and used Peruta in the decision.

The attorney for Baker is now the co-counsel for the plaintiffs in Hollis v. Holder, working with our very own NoloContendere on overturning the MB ban, and the NFA.

An en banc 9th circuit panel (all 9 judges) used peruta to decide Baker? If so that is good news...if it was just 1 or 3 judges that used peruta...doesn't mean much.

I believe it was a three judge panel decided Peruta, then, same day, decided Baker citing Peruta in the decision.

Now the original Peruta decision is being reheard by a full panel.

I can't seem to find any reason given from any source as to why the sudden full panel rehearing. The original decision was not contested by the city or LEO involved.

I heard the CA attorney general requested the en banc review along with the Police Chiefs Association and the CA Peace Officers Association.

I also read that as of November there was no one with the standing to appeal the panel decision.

So I'm confused.

I know we are supposed to have an independent judiciary but I cannot help but think word came from on high to figure out a way to rehear the case and reverse the decision. After living this many years, I realize the system is rigged. Had the ruling been the opposite initially, it would never have been reheard.
