I saw this pop up on Gunbroker this morning.

The seller thinks this may have been originally purchased as a stripped lower and then built into a rifle. If that is the case, would this be legal to build into a pistol? If this is being sold and sent to an FFL as a preban stripped, and the FFL logs it into his paperwork/4473 as a stripped or unassigned lower, wouldn't that make it ok anyway? I wouldn't want to do something illegal, but my lack of knowledge makes me think its ok.

No.  Not legal. If it was ever a rifle then ATF says its a no go to put it back to pistol.

No.  Not legal. If it was ever first built into a rifle then ATF says its a no go to put it back to pistol.

If it were first built into a pistol, BATFE's position is that it could then be built into a rifle and subsequently turned back into a pistol. If it were first built into a rifle, however, it would always be a rifle.

So pretty much if the first assembly included a carbine stock, it was first a pistol.  ATF allows the use of a receiver extention as a pistol tube.  So if the stock was not attached to the receiver extension at the time of the initial install, it was first technically a pistol

Of course this is a technicality, but it sounds good, and besides, they do it to us

Be careful as this is NOT a pre ban. The cutoff is 35222 and this is 35512.
