I saw this pop up on Gunbroker this morning.
http://www.gunbroker.com/Auction/ViewItem.aspx?Item=554817757 The seller thinks this may have been originally purchased as a stripped lower and then built into a rifle. If that is the case, would this be legal to build into a pistol? If this is being sold and sent to an FFL as a preban stripped, and the FFL logs it into his paperwork/4473 as a stripped or unassigned lower, wouldn't that make it ok anyway? I wouldn't want to do something illegal, but my lack of knowledge makes me think its ok. |

FIFY If it were first built into a pistol, BATFE's position is that it could then be built into a rifle and subsequently turned back into a pistol. If it were first built into a rifle, however, it would always be a rifle. |

So pretty much if the first assembly included a carbine stock, it was first a pistol. ATF allows the use of a receiver extention as a pistol tube. So if the stock was not attached to the receiver extension at the time of the initial install, it was first technically a pistol
Of course this is a technicality, but it sounds good, and besides, they do it to us |

Current interpretation from ATF is: 1) virgin stripped lower can be made into a pistol 2) virgin lower with stock can be made into a pistol if the stock is first removed --- both of these options can then be made into a rifle and back into a pistol 3) virgin lower with stock that is then barreled becomes a rifle and can never be made into a pistol, regardless of if the lower is eventually stripped down. |
