In Illinois, I understand there is a 3 day waiting period for a handgun.  If the background check is still pending after the 3 days, can the dealer transfer the firearm to the person? Can they hold it until the background check comes through? What recourse does the buyer have?  Does anyone have any state laws to refer me to?  Has anyone had this issue before?  (And, yes, I've referred it over to a firearms attorney, but am looking for other people's experience.)

What happens if a customer orders a firearm, and when he comes into pick it up, ISP issues something other than an approval on the FTIP?
The actual transfer of the firearm cannot take place until there is an approval from the FTIP system, regardless of when the agreement was reached. If the FFL receives a transaction number, they cannot complete the transfer until they receive an approval.

But what happens if days and weeks go by and no approval is gained from the FTIP system? What protects gun owners from unreasonable delays and infringements on the right to purchase a firearm?

Nothing, if their are delays you have to wait.

So if there delay is a week or two or three, the three day waiting period is void and you have to wait?

Someone else must have run into this before?

Yes that is correct, last Christmas the ISP were backed way up and it took 10 days to get approval. Just have to wait.

What has happened to the system. Just bought a bullpup and was told to callback in 4-5 days. Has It slowed down or are there exponentially more transfers going through. Never had to wait past the legal time in 44 years. I have a FOID, 3 ccw lic. and a C+R license. You would hope at some point you have proved you're not an undesirable when it comes to gun ownership.
