In the state of PA, is it required by law for one PA resident to go through an FFL to sell a handgun to another PA resident?  Basically, to do it in the presence of an FFL?

What about rifles?

Handgun has to be done through an FFL via a 4473/NICS check.

Rifles and shotguns are GTG between individuals FTF. IIRC you can even ship one directly to another PA resident.

I guess the main reason it has to be done through an FFL is because FFLs are the only people/entities who have access to the NICS?

Handgun transfers have to go through a dealer because that is what PA law requires.

Technically it could go through a county sheriff, but good luck with that.

This...what good is their illegal database if it's not up to date.  PA doesn't use NICS, they use PICS.

PA most certainly does use NICS. It's just a point of contact state. The FFL contacts PSP (PICS) who then contacts NICS.

I attended one of those ATF outreach programs for FFLs last year and PSP was there as well. PSP flat out admitted that they scan the forms before destroying them and that their interpretation of the law allows them to scan the forms while destroying the paper copies.

They don't hide the fact that they do it.
