Sooooo many people here secretly want the ATF to fuck with him. You can feel it in the air.
Homie's troll game is strong. No way those are not SBR's. If by some miracle they aren't I give him more props for a lack of all fucks. Pretty obvious what the ATF will do if this becomes a thing. "It has come to our attention that the current opinion letter on braces makes us look dumber than a box of shit so to rectify this situation from this date forward putting a brace on a pistol will make it into a rifle and subject to all NFA laws for rifles." Serious question: Only thing I can remember that was as widespread as braces being suddenly wiped off the map was Street Sweepers and such back in the day. Has there been anything with as many units in the wild as braces that have been suddenly outlawed by decree? |

The ATF's opinion and enforceable interpretations of law are two different things. Even the ATF's opinion that adding a VFG to a pistol constitutes a "redesign" of the weapon hasn't been looked upon favorably by judges actually trying cases and applying common sense to the enforcement of laws.
Here is a perfect example of the ATF getting their ass handed to them in court because their "opinion" about what constitutes a the "redesign" into an NFA firearm didn't convince the court. The court found that accessories added by the end user don't change how the gun was originally designed. The ATF hasn't changed their tune, though. So I have a hard time believing that a court would find that where you PUT the gun when you shoot would be considered a "redesign" of the weapon: "Even after being modified with grips, the pistols are still "pistols" as defined above and not "any other weapon" as defined by 26 U.S.C. section 5845(e)."
"As to the motion to dismiss concerning the two pistols, thiscourt concludes that the weapons are "pistols" as defined and are not "any other weapons," and that the motion to dismiss as to the pistol counts should be granted." |

Since the recent White Paper came out that had one of the heads of ATF question the current opinion on shouldering pistol braces, wouldn't it be tough for the ATF to push this issue, since one of their own thinks the opinion is too extreme?
i would think a defense lawyer would love to have that paper as evidence against the ATF's stance. |
