Why do you think the gay couple's lawyer does not want jail time? Do you think they are trying to avoid creating a real live martyr in the debate? A Christian woman imprisoned for her religious beliefs held by a very large portion of America. The courts often push unpopular topics. And sometimes those topics take hold and the courts can change public opinion. Sometimes, like the Dred Scott decision, they do not and the people refuse to accept the apparent authority of the Supreme Court because the Court is on the wrong side of society and history.
