SAN MARCOS, Texas – A reserve sheriff's deputy is facing aggravated assault with a deadly weapon charges after police say he opened fire on a truck driver he thought had cut him off.

After nearly 15 years behind the wheel of an 18-wheeler, Frank Collins III thought he had seen it all. He was wrong.

"Never seen nothing like this," the 56-year-old said. "It's just too far-fetched."

But what the Fort Worth man experienced late Sunday night actually happened, according to San Marcos police.

Collins was driving along an Interstate 35 frontage road outside of Austin when he says he was suddenly cut off by a red pickup truck.

"All of a sudden, this red truck comes around me, pulls in front of me, and hit his brakes," Collins said.

The father said the red truck braked on and off for about a half-mile, until the two were forced to stop.

"Then, he gets out, started walking toward me, and just starts popping -- shooting at me," Collins said.

News 8 got footage of the truck in question. There are a half-dozen bullet holes, including one directly through the windshield where Collins was sitting in disbelief.

"I had ducked over by then," he said.

Somehow Collins was able to shift the truck into gear and slowly pull away. He struck the pickup and then sped onto I-35 looking for help.

The red truck followed.

San Marcos police arrested 41-year-old Daniel Zurita Jr, who they say was driving the pickup truck. He is a reserve deputy in Wilson County, Texas.

Collins said the man wasn't in a marked car, didn't show a badge, and never said a word.

News 8 reached out for comment to Wilson County, but didn't hear back.

Zuria was arrested and released form the Hays County Jail on a $50,000 bond, according to News 8's sister station in Austin, KVUE.

I have on occasion gotten pissed off at a shitty driver, but never once have I thought about shooting at or killing someone for being a bad driver. Dumbass needs some tender loving in a prison cell.

the Poor police officer was blinded in the darkness and the headlights and confused the Peterbult for a Mac truck. This was obviously the truckers fault. The brave officer heard the engine and thought an agressive pitbull on PCP was on the hood of the truck. He should be rehired by another Texas PD and given a promotion. and besides it isnt like he was violent towards the driver. It was the evil bulldog what got him riled.
