I won a $5 bet on this trial decision from a lawyer of all people.
Not enough evidence and even if they found him guilty I also made the bet he would get a probated sentence. |

I am more ok with this than most . A drunk driver killed my father .

Good acquittal.
I've sometimes wondered what would happen if a drunk driver hit my car and killed my wife, or one or more of my kids. Having a weapon within quick reach, it would be very difficult to keep from putting 10 rounds into the guy. |

Investigators testified that a bullet fragment found in Banda's car could have come from a .357-caliber gun, and that ammunition for such a gun was found in Barajas' home, along with a holster. Cammack said his client never owned a gun and that tests showed the bullet fragment also could have come from another weapon. It was a damn good thing the drunk who killed my brother didn't survive. He lived for 12 hours, I was too much an emotional wreck during that time.
I still want to track down the owner of the truck but he got his punishment through the courts.

I wonder if he was shot earlier (maybe in the parking lot of the bar he was drinking at) and was driving to get help or get away from whoever shot him. It's possible he passed away behind the wheel which could have caused the crash. Lots of possibilities means lots of reasonable doubt. Good acquittal. |

If I recall correctly, the Dad did not own a gun, or argued he did not own a gun. But they did find ammo in his home. Or something along those lines. So I don't think they have any idea about what happened to the gun. |
