B.S.  It is now policy from the top down, to look for fine revenue.  Rush has spent the last few days talking about OSHA inspectors hitting construction and work sites.  



No. our town has been doing it for years and for the amount of work and man hours put in to writing one citation for $250 there is no way it generates revenue. But what it does do is protects your property values and keeps certain neighborhoods from turning into slums.

If it is listed in the contract, the landlord can give 24 hours notice and do a walk through but he cannot do it on behalf of the government.

Not if the city then prosecutes the renter for any unsafe conditions.  Think about this for a minute.  A citation is a criminal charge.  I cannot circumvent consent or a warrant through an outside entity, they essentially become an employee of the government.  

Can the landlord walk through, yes, can he take others through, no.


It is not about the renter it is the Landlord they cannot prosecute the tenant.period.

no matter what the "lease" says - if that is your legal occupancy, then you are entitled to all of the rights, priveledges and privacy therein.  Reasonable exceptions include situations that might be an endangerment to others - such as utilities or fire risk.  

This "inspection" might be under the guise of that above disclaimer - so YMMV and I am not a lawyer.

Laws are different from place to place, state to state, never mind what is in the signed contract could allow this to happen.





Federal constitutional law is never different from state to state unless it is more restrictive than the original intent.  I.E.  a car by federal law (A constitutional decision) is an exigent circumstance on its own, but in Utah, the USC has decided that more exigency than simply the car must exist along with probable cause in order to conduct a warrantless search of a vehicle.

Not that i support it but it is what it is. If Steve has done something to make his home unsafe which i am sure he problably has not it will still fall on the lanlord to fix it by eviction or whatever the remedy may be.  There is a reason these codes were VOTED into law and some communities decided to inspect all rentals not just slum areas.

Your lease does not shield you from local laws.  Additionally -  you don't own the property and the owner does have to comply with local laws. Call the number listed on the notice and ask for the specific law that supports their right to inspect.  Don't be a dick about it - be nice.

All communities are different In the case of apartments my wife has to inspect a percentage of the homes. she finds a lot of the tenents actually point out code violations .I have seen pictures it is a shame what some people live in.

You (motown-steve/tenant) don't have to worry about it, normally citations are issued to the owner, not the tenant. It may be that some other tenant filed a complaint, they found problems and want to inspect all the apartments. You would be amazed at what can be considered a violation. I got written up for stuff like missing light bulbs, missing outlet covers, something that I never understood about how I attached the water heater etc.

I beleive the city is attempting to dupe you into giving permission hoping that you will not challenge it.



Most people do not know their rights, they have nothing to hide and they will always allow a government official in.

i live in dallas  

i got one of them thiings on my door about 3 weeks ago,


picked up the dead hooker and was pretty much good to go  



maybe i "gave in to them"     or even  " sold out "  

i was home when they knocked. < after the 48 hour notice.. >

i opened ..  they said who they were..    i bladed...   then i opened the door all the way and said...  sure  knock your self out..    

she peeked in for about 1/4 of a sec and said.. thanks

Seriously, the people who do code enforcement couldn't give a shit how many guns you have or how sticky your sheets are.  If they're coming in, it's either because a mandatory periodic rental property inspection is due, or because someone filed a complaint.

Just let 'em in for 5 minutes to walk your place, see what they need to about the structure/facilities (which you don't own and have no privacy claim to), and they'll be on their way.  If you have a beef with them coming in, then be there to escort them during their inspection.

The bitch of living in 'attached housing' is that you're subject to regulations that govern the larger structure.  Don't like it, buy a house.

Its aimed at the landlord, not you. If you don't allow them in to inspect, the landlord will not get a certificate of compliance, and your building will be shut downby the city  and you'll be homeless. So you might want to reconsider that stance of yours.

Wrong. The landlord has to give you 24 hours notice for non-emergencies. For emergencies, he can come in without a 24 hour notice. No warrant needed.

Buddy, I'm not saying you fail as a patriot, I'm trying to help people out.  I don't think some fathom the sheer number of things that are illegal but would not seem so.  Code violation books, atleast in the city I work for, are thick and complicated, they cover everything including having an inoperable car next to your home or weeds growing.



I am all for a safe and clean neighborhood but the people of the city stil need to ask permission and be legal about it.  They cannot go around telling people that they are going to do something.



I will be far more receptive to



"The city of blah blah blah would appreciate your assistance in inspecting your apartment for potential code violations.  With your permission, we would like to walk through your place of residence with you and make sure that no unsafe conditions exist.  We appreciate any assistance you provide."



Instead of



"We are conducting inspections for code violations in your complex.  We will be entering after the period of notice has expired."



OP, what exactly did the note say?

Here is the thing Slower Code enforcement is not a state to State thing it is A City or County thing. If i were steve i would consult an attorney in his area to get legal advice.




The city must conform to the counties standards, the county to the state and the state to federal law.

You (motown-steve/tenant) don't have to worry about it, normally citations are issued to the owner, not the tenant. It may be that some other tenant filed a complaint, they found problems and want to inspect all the apartments. You would be amazed at what can be considered a violation. I got written up for stuff like missing light bulbs, missing outlet covers, something that I never understood about how I attached the water heater etc.





While you are always the voice of tempered reason, I think the OP's rant is based in principal.  That being said, I'm unfortunately a fence-rider on this one.  A) He's got every right to decry the intrusion of government into his home.  and B) If he's not the property owner, he may have given up the right to complain when he signed the lease.

Seriously? Or, he could just let them in to see what particular code violation may exist and move on. What's the big fucking deal?




God, I am starting to sound like a paranoid constitutionalist.



The big fucking deal is the fact that we still enjoy specific rights in this country and excercising them is what makes it so great.  I have so many ways to legally enter a home when something unlawful is occurring.  I LOVE writing search warrants because it is so much harder to follow the constitution than it is to just say fuck it, lets violate his rights.
