After watching the videos a few weeks, not surprised at all that the policeman was charged.

He appeared to be the aggressor and chased after the victim as he tried to get away from him.

Witnesses said O'Neal asked DeLustro multiple times, "Do you want to do this?" To which DeLustro said, "Come on you (expletive) (expletive)." DeLustro used a homophobic slur, according to the affidavit. *

As the two men exchanged blows, bystanders tried to separate them.

Eventually, DeLustro identified himself as law enforcement, displaying his Summerville badge before it fell to the ground, according to the affidavit. Witnesses told investigators that DeLustro said he would arrest O'Neal as the two men fought.

DeLustro's handgun fell out of its holster and to the ground during the fight.

O'Neal attempted to end the fight and disengage from the situation, saying he wanted to leave, according to the affidavit. A bystander who restrained the off-duty Summerville officer told SLED that DeLustro said he would shoot O'Neal if he left.


*"Come on, you fucking faggot!" Lovely. Such high standards of personal professionalism. And then at his court appearance he acts like he's due a get out of jail free card because it's all about him.

One has to wonder what precipitated this situation. Likely a perceived slight aka nothing. That's almost always what happens.
