You have filed in NJ, therefor you need to post any further actions, results in the NJ forum. GD sucks!, opiates are needed to follow those threads. |

Members does this affect specifically NJ? Yes, I'm sure Nolo will do his best at keeping us informed. I won't be opposed to anyone help Nolo out by finding his update GD and quote posting them here. iF by chance there is a double post by anyone OR by two or more individuals just delete the info as a courtesy to us all and upper management. Good luck to us all. |

I have heard the "it can't happen, not here" before. But despite those words it did.
And I have in fact have been very let down by a half hearted attempt to replicate our work from 2013 in New Jersey in 2015. But I refuse to quit and I am glad Nolo is on the job making thing happen. When we quit we are done, so don't give in. |

View Quote Just read through it. I'm not all that smart but are you trying to address the "justifiable" need thing? Because it sounds to me like the two plaintiff's met the justifiable need and should be awarded their permits. How is this supposed to help everyone else? If your case is won would that mean anyone in the state could apply and possibly get a CCW? I now it's not going to happen just like that I'm just trying to understand the complaint and what you are trying to do. Like I said, I'm not exactly smart. |

Interesting. I would hope this goes our way but there are some factors in constitutional
cases. There's precedent: Ninth District AP holding that the 2nd Amendment does not give the right to carry (I wonder what those assholes thought the "right to *bear* arms" means . . .) but maybe that issue will be revisited and "clarified." Then there's the fact that the Fed Court District of NJ is probably no less liberal than the Ninth District in Cal. On the other side, maybe this will finally show how New Jersey is not a "may issue' state and that it is virtually impossible for anyone, no matter haw valid the reason, to successfully obtain a CCW If this goes against the plaintiff and winds up in the Supreme Court (and they agree to hear it), hopefully Trump will be in the WH and has appointed the tie breaking conservative Justice. A tie vote in the Supreme Court would mean the lower court holding remains. Going with an "excuse" is what I'm thinking. In constitutional cases, the court tries to find a non-constitutional basis for deciding it so they don't need to change the status quo. In NJ, they'll do whatever they can to keep from hearing this issue. That's my best measured guess considering what has happened here in the past. Best of luck. Your going to have to "rub a lamp" if you think this will go anywhere IMHO. |

We had a conference with the judge on Friday. He set a briefing schedule for the defendants response to our motion for preliminary injunction and motions to dismiss if the defendants wish to file one (they will). Hearing is not set yet.

I'm pretty sure any ruling there is nearly meaningless here. How's that Heller ruling working out for DC, NY, IL, or CA? 8 years since Heller and it's worse in those places than it was before the ruling. They'll change the law just enough (or ignore the ruling entirely) to maintain the carry ban. 2018, Sweeny, SAFE 2.0, is all anyone needs to know about where NJ is heading in the fight against tyranny. They won't even have to try hard, a raise of hands, and a pen swipe away from every gun banner's wet dream. |
