I'm hoping what you're saying is if an adult requests the pics and knowingly receives them should be charged.

For the same reason most states have adopted caveats to statutory rape laws where <21 or within X number of years makes it ok to do the nasty.

Yeah, my phone is awesome, it can differentiate between any ordinary picture and child porn before it even notifies me of a text.
