Looks like if you are going to be denied a PPP (pistol purchase permit) for any reason you will now be entered into an SBI database per a law passed by the NC leg.

HB 1415 Designed to Register Gun Owners

[Analysis]  HB 1415, "Gun Owner Registration Act", was scheduled for a 2nd reading today and is scheduled for a 3rd reading tomorrow, Tuesday, August 22.  It had the original intention of simply reporting back to the home county sheriff if a person was denied a pistol purchase permit in a different county.  As bills involving guns tend to do, this one has been amended beyond recognition.  In its present form, it now will register anyone who is denied a permit in a DATABASE with the State Bureau of Investigation.  

The House has attempted to pull one over on you by amending and fast tracking this bill in order to avoid constituent input.  In its present form, HB 1415 is unnecessarily obtrusive and is opposed by GRNC.

MAKING A BAD BILL WORSE

To add insult to injury, WILMA SHERRILL (R - Buncombe) has introduced an amendment to include people under protective orders to this database.  
People under protective orders have not been convicted of anything and in fact may not have even had an opportunity to defend themselves in court.

Rep. Sherrill would do well to remember another Republican named Don Munford.  Munford, as you may recall crossed gun owners as the sponsor of the "Homicide Prevention Act" which seizes the firearms of anyone who is the subject of a protective order.  Domestic Homicides have jumped dramatically since that passed into law.

As a result of this slap to gun owners, GRNC ran radio spots against Munford during a hotly contested primary, which he narrowly eked out the nomination.  Munford went on to lose to his opponent in the general election.

SHERIFFS' DESCRETION BROAD IN DENIALS

In the matter of Pistol Purchase Permits, a county sheriff's discretion in issuing a denial is broad.  The reasons are too numerous to fully quantify her, but for instance a sheriff is allowed to set the number of permits he will grant in any given period.  So if the sheriff decides that he will only issue three permits a year and you apply for a fourth one that would be grounds for denial.  In that case you would then be registered in an SBI DATABASE!

Dear Representative:

I am OPPOSED to HB 1415, "The Gun Owners Registration Act."  I urge you to vote against this act and use all of your influence to prevent it from becoming law.

As it now stands, this bill is obtrusive and Orwellian.  The reasons for denial of a pistol purchase permit are broad and sometimes arbitrary; hardly a sound reason to register gun owners in a permanent SBI database.  In addition to this, the Sherrill amendment would register a gun owner in a case where he is "Guilty until proven Innocent."

HB 1415 is a bad bill and any vote for it will be counted as an anti-gun vote by GRNC.  I will be monitoring the progress of this matter.  Please vote AGAINST HB 1415.

A BILL TO BE ENTITLED

AN ACT To provide that denial of a license or permit to PURCHASE A PISTOL OR SURRENDER OF A FIREARM OR PERMIT UNDER G.S. 50B-3.1 SHALL BE REPORTED TO THE STATE BUREAU OF investigation to be entered into an appropriate computerized database that is accessible to sheriffs statewide.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 52A of Chapter 14 of the General Statutes is amended by adding a new section to read:

"§ 14-404.1. Report gun and permit surrenders and denials to SBI.

(a)       If a sheriff declines to issue a permit as provided by G.S. 14‑404(b), the sheriff shall notify the State Bureau of Investigation and provide all of the following information to the State Bureau of Investigation for entry into a State computerized database designated by the State Bureau of Investigation:

(1)       A statement that the license or permit was denied in accordance with G.S. 14‑404(b).

(2)       The date of the denial.

(3)       The county in which the license or permit was denied.

(4)       Sufficient information to identify the applicant.

(a1)     Whenever the sheriff obtains firearms, machine guns, ammunition, permits to purchase firearms, or permits to carry concealed firearms pursuant to a surrender under G.S. 50B-3.1, the sheriff shall notify the State Bureau of Investigation and shall provide all of the following information to the State Bureau of Investigation for entry into a State computerized database designated by the State Bureau of Investigation:

(1)       A statement summarizing the basis for the surrender.

(2)       The date of surrender.

(3)       The county in which the surrender was ordered.

(4)       Sufficient information to identify the person subject to the surrender.

(b)       The State Bureau of Investigation shall enter any information provided to it in compliance with subsections (a) and (a1) of this section into the appropriate State computer database within 24 hours of its receipt and in such a manner that a notation of the denial or surrender will appear in any subsequent record check conducted in accordance with this Article.  Any information entered into the database in accordance with subsection (a) of this section shall be automatically deleted from the database eight years from the date it was entered.

(c)       If a person successfully appeals the denial of a permit as provided by G.S. 14‑404(b), then the person may provide the sheriff with an official copy of the court's determination and request in writing that the sheriff remove the notation regarding the denial of the person's application for a permit from the appropriate State computerized database.  The sheriff shall notify the State Bureau of Investigation of any request made in compliance with this subsection within 72 hours of the receipt of the request. The State Bureau of Investigation shall remove the notation within 72 hours of its receipt of the request from the sheriff."

SECTION 2.  By September 1, 2006, the State Bureau of Investigation shall have identified an appropriate State computerized database that is easily accessible and available to sheriffs statewide, developed any necessary software, provided training on use of the database, and taken any other action necessary to ensure that the database is fully operational.

SECTION 3.  With funds appropriated to the Department of Justice in the 2005-2006 fiscal year, the State Bureau of Investigation shall begin to implement the provisions of this act, including identifying a State computerized database, developing necessary software, and providing training on use of the database.

SECTION 4.  Section 1 of this act becomes effective September 1, 2005.  The remainder of this act is effective when it becomes law.


If you read this carefully it is not registration of gunowners. It's reporting denial of permit requests.


But this bill is bad legislation, because it does nothing but make the fuckers in Raleigh feel better, and is being fast tracked by Sherill and other RINO's

As it is written, it does not matter WHY you are denied, could be one of the million reasons they have like being over your purchase limit, you end up LABELED as a BAD GUY!  I have never been denied...but think this sucks anyway!
