LEGISLATIVE UPDATE -18 December 2003

FOR WIDEST POSSIBLE DISTRIBUTION.

Judge Steven Ohmer called for an additional hearing to
review more motions made by the plaintiff's opposed to
Missouri's new LTC law [HB-349]. The hearing was held
this morning at 9:30 am.

To the surprise of many, Judge Ohmer ran our issue
LAST, making us wait while he waded through the other
cases before his court.

The Plaintiff's had made a motion to re-hear the
Hancock argument... That motion was DENIED.

The Plaintiff's made a motion to return their $250,000
Bond money. That motion was DENIED.

Plaintiff's brief's before the Supreme Court are due
tomorrow.

The stage is now set. We are on to the Missouri
Supreme Court.

Thanks for the update Kpel.  I want to point out that the motions which were denied are collateral in nature and have no material bearing on the issue which will be put before the MO Supreme Court, so its not a big deal that they were denied.  Frankly, to even try to get their bond back tells me how much the plaintiffs think they own this judge.
