Called to check on the status of my transfer and was forwarded to Nichole.

She stated that she sent the forms back to my dealer because I put 5.56 as the caliber for my OPS INC suppressor on the form 4 but the serial number for that suppressor was originally registered as .22

She said that my dealer would have to provide her with proof the the suppressor is for 5.56 before she would approve the transfer.

Looks like I won't have my 15th model for the Hun Farm Shoot.

That sucks.

But, this is why I let the dealer fill out the form 4. It is easier for him to fill out, as he should have the form 3 in hand for reference.

As far as I understand it, My form 4 was correct it was the original form 1 that is not correct. I'll find out for sure when it gets back to my dealer.

I hope she didnt kick it back because it is listed as ".223" and your form 4 says "5.56", that would really suck. Or maybe the form 1 had a typo ".22".

I dont know what caliber OPS puts on their suppressors, I would tend to believe that they would list them as 5.56.

In other words it sounds like a "cluster fuck".

This was my first response and she said " I know they are the same." in a voice that indicated I had insulted her intelligance.

Or maybe the form 1 had a typo ".22".

This is what I believe has happened.

Ops Inc does not do form 1ns. form 1ns are for citizens not manufacturers.

Hmmm... 5.56/25.4 = 0.2188. I would hope that's all the "proof" you need.

Well, it's not.

Paperwork has to match.

The suppressor had to probably be transferred to a dealer in his state on a Form 1, correct?

It was probably at that point it was incorrectly marked, perhaps the online PDF was used and a key didn't get hit when it was supposed to (3) ?

Form Lesson:

Form 1 : Individual makes a NFA firearm (AOW, SBS, SBR, Suppressor) pays tax
Form 2 : SOT makes a NFA firearm, no tax
Form 3 : Tax free transfer between SOT's
Form 4: Tax paid transfer between individuals, or SOT and an individual
Form 5: Tax free transfer to LEO, or temp transfer for repair.

Sounds familiar. My dealer put .223 for my OPS 15th and it got kicked back because the silencer has .22 on it not .223. Dealer made correction and signed beside the change and it cleared a week later.

Did your dealer buy the can from OPS INC?

I've transfered several OPS cans on form 3s without issue, as well as a few locally on form 4s. If its true the form 2s are listed a .22, you'd think the form 3s would get kicked back as well?
I wonder if they check as deep on the form 3s as the 4s? Its probably also up to the Examiner how specific they want to be.

I agree it may be up to the Examiner. My 15th was transferred from you to the dealer here in Franklin, TN. When we were filling out the form 4 we just put .223 not even thinking that the silencer actually had .22 on it. It all worked out in the end. When the 12th model arrives I will pay closer attention.

I got mine from Adco as well. I just copied the information for my form 4 straight off Adco's form 3. I didn't even check the suppressor now that you mention it. We must have the same thing going on.

I feel for you buddy, mine was kicked back because the dealer forgot to include "MBS" in the serial # of my original paperwork. That added a month to my form 4 approval. Still good guys, though so I don't mean to give them crap.

I guess the lesson for us is that we should ask to see the form 3s and compare the details before the examiner has to.

The form 2's say .22 cal. The form 3's and 5's say 5.56/.223. I guess they should say .22, .223, .224, and 5.56. I haven't heard of a problem before. Sorry it happened. I guess it is just up to the individual at ATF. I will talk to them about it and see what works best for them.

It might be worth a call to the supervisor of the ATF agent to explain that they are all the same like 22 and 556, it might not work, but it would be worth a call. However, make sure not to shoot 22LR in a 556 can.

I could not agree more. I try not to shoot more than a couple thousand before I blow some .223 through it.
