Advertise in the EE here, in your own state you may sell rifle under private transfer without any FFL dealer involvement. For outta state, you must ship rifle to a licensed FFL dealer where he will transfer rifle to the buyer. IMHO you want a signed, cetified copy of the receivers(buyers dealer) FFL license in hand before shipping rifle. Yes USPS or UPS is okay for shipping. Mike |

You, as the seller, are not legally required to SEND the rifle from an FFL. The rifle, sent out of state, must be RECEIVED by an FFL.
If you were an FFL yourself, you would be required to obtain an ink-signed copy of the receiver's FFL. Since you aren't an FFL, this is NOT required, and many FFLs will no longer send a copy of their license to a non-licensee. Fortunately, ATF has put up a website where you can verify the validity of a license. The receiving FFL need only send you the FFL number, and you can enter it on the website and verify that the info matches, and that the license is valid. Here's the link you need to check out a dealer once you have his FFL number. You don't even need the whole number, just the first three and the last five.

Yes, but the ATF has the following warning on their website after you enter the numbers to check out the FFL's validity: Warning: No one may use this screen, in lieu of the required certified copy of a Federal Firearms License, to acquire a firearm. It sounds like even if you provide someone the numbers, they still need the ink-signed copy of the FFL before shipping the firearm. Is this correct? |

The latest BATF requirement is that signed copies of FFL's are only to be used between FFL holders. Unsigned copies of FFL's are to be used between licensed and unlicensed parties. They want to be able to trace where the weapon was shipped, but they don't like the idea of non-licensee's having signed copies of FFL's.

Right; that warning is for FFL holders, who must have a signed copy of the receiver's FFL.
Non-FFL holders do NOT need this. Nor are they required to have a copy of the FFL at all, or even required to check the web page. But, doing so is a good CYA move. -Troy |
