...Roe v. Wade is overturned or SCOTUS rules that the Second Amendment is an individual right?
Any predictions? Are these reasonable expectations under the makeup of the court, or are either of these highly unlikely? |
|
SCOTUS isn't going to touch a RKBA case anytime soon.
Roe v. Wade won't be overturned in a single decision. It'll be chipped away at for a significant number of years. |
|
Won't happen on either. |

And there was a headline in Yahoo that several states are ready to launch anti-abortion legislation any time. www.washtimes.com/upi/20060131-090347-1251r.htm Should be interesting. |

The Second Amendment will be confirmed as a individual right by SCOTUS
However that wont change much, since then each state would have to be sued to get them to conform. Roe Vs Wade will never be touched because its far too popular. The fact it is not popular on AR15.com does not mean its not valued by the majority of the people in this country. Gun control is no longer popular, because it has been proven not to work, so people will not go to bat for it. |
|
Me too - get over it, abortion is legal and its going to stay that way. Don't like it, then go live in some fundamentalist shithole like Iran. You are free to hold your religeous beliefs - but NOT to force them on others. Fucking US Taliban .... |
|
|
There are still more libs on the court.
Don't hold your breath. |

And people call me a DU troll. |

The definition of murder is a police power. Police powers are inherent in the States, not the Federal Government.
If Roe v Wade is ever overturned, it will be on those grounds. The court will probably rule that a state has the right to pass an abortion ban if it wishes or vice versa. |
|
An overturn of Roe v Wade will not mean abortion is then illegal. What it would mean is that it is each State's issue and not a right guaranteed by the USC. Thats the way it SHOULD be. |

In your opinion, not mine. |

forget the sarcasm tag, or do you really believe that? |
||
|
Perhaps you're missing the point of the Supreme Court and its lifetime appointments, ie not to give into what's popular. My prediction is Roe v Wade will be overturned in 5-10 years and will put the onus of the legality of abortions back where it belongs, the states. |

I keep seeing this here. Someone enlighten me: WHY? TIA --VT |

I don't care about RvW anymore. The constant media yammering about it every time anything involving the SCOTUS comes up has completely deadened me on the issue. They refuse to talk about any of the other important issues that might come up before the court, and I'm sick of it. It can stay for all eternity, or it can be overturned tomorrow. It won't have any impact on my personal life. I just ran out of give-a-shit. Sorry.
The 2nd Amendment does have a decent chance of getting reaffirmed, though. I hope it does. I won't be happy until Wal-Mart is stocking M-249s. |
|
Ding Ding Ding, we have a winner! Not to mention how dangerous it is to interpret the constitution in any other means than it was written. If the 4th amendment does not say 'right to privacy' there isn't one in the 4th. Therefore any such right could ONLY come from the 9th. That is the whole reason it is in there, they knew by explicitly listing rights that if they forgot any it could be argued that they are therefore not rights, the 9th was put in to cover any implicit rights. It was wrongly decided period, and NEEDS to be fixed. |

Any decision they make risks upsetting the status quo, and that's what they want to preserve above all else. If they rule against the 2nd in a major way, some governments will start banning guns completely. If they rule a major gun law unconstitutional, then we'll suddenly be back to the days of buying a Thompson at the hardware store for cash with no background check and no paper trail. Either would thoroughly piss off a LOT of people. So the only thing we see is rulings based on technicalities and narrow definitions that limit the scope of the decision to that single case only without actually doing anything for anyone else. |

Yup. Miller (1939) will be the last RTKBA ever. |

Thank you, sir. Very well put, and I understand completely. I have been enlightened. --VT |

What he said. Listening to the zealots gets old. |
|

Expect to see nothing concerning those two issues and a lot of expansion of government powers IMO.
Overall I think Alito will be better than the liberals on the court, but I do worry that he will probably support ever-increasing big government. |

Gawd another abortion thread.
Seriously this is too much. This thread should be about the 2nd, not Baby Killing. |

Well, the FACT is that it is not murder. It is a religious matter. That is where the objection to it comes from. |
|||
|
Actually, for most of us here it has more to do with the FACT the Feds shouldn't be regulating it and it should be left to the states. |
||||
|
For most, it is a religious issue. For the more informed, it is about it being left to the states. |

Abortion was a state's right before Roe v Wade. In some states, it was legal, in other not. Learn your history. |

Best... line... EVER! |

Decisions are made by majority vote.
There are 9 justices on the Supreme Court. Alito’s appointment now means there are 4 conservative justices. Do the math!! |

Fixed it for you. |

What has been explained? |

Read a few posts after that. I did acknowledge in a later post in this thread that it is not ALWAYS a religious matter, but most of the time it is. In the spirit of your response, I will IGNORE whatever I wish. Just because someone 'splains something does not necessarily make it so. |

Ban Abortion. We need the children to pay the taxes for our Social Security! NOT!!
I doubt they will hear any cases that do either. 1. The Supreme Court has a history of avoiding 2nd Amendment issues. 2. The Supreme Court will not want to contradict any previous rulings that have been standing for some time. |
|
ETA - you made me laugh when you called me a religious hypocrite after I mentioned a scientific defintion, and I'm laughing now. You have that effect on me. |
|
|
When did I call you a religious hypocrite? I generally avoid discussions on religion. |

When why have they not undone the NFA, even in part? |
