ALCOHOLIC BEVERAGE CONTROL, SAN DIEGO POLICE ARREST 10 FOLLOWING FOUR MONTH DRUG INVESTIGATION

The California Business, Transportation & Housing Agency's Department of Alcoholic Beverage Control issued the following press release:

On February 18, 2005, Investigators from the California Department of Alcoholic Beverage Control (ABC) and San Diego Police Department arrested 10 individuals at the Slip Inn, 4046 30th Street in San Diego on various illegal drug charges.

The actions were taken following a four month joint narcotics investigation.

The owner of the business was taken into custody on a charge of being drunk in public, a bartender was taken into custody for facilitating sales of methamphetamines, six patrons were arrested for either selling narcotics, facilitating unlawful drug sales or possession of illegal drugs and two patrons were arrested on outstanding warrants.

Undercover Investigators were able to make nine separate purchases of methamphetamines and one purchase of marijuana during the investigation.

The ABC will bring disciplinary action against the owner of the Slip Inn. The penalty ranges from a fine, to a suspension or revocation of the license. "This is the kind of action that helps build a safer and stronger community," said ABC Director Jerry Jolly. "We're grateful to the San Diego Police for their efforts and cooperation."

It's not uncommon here, because whatever species of "keeping a disorderly house" is committed by allowing (or failing to prevent) drug use or sales on licensed premises is a violation of the beverage code. The drug arrests are technically incidental to the license issue though obviously central for the people arrested.

I have been told by ABC agents in the past that if they can buy drugs inside a bar, from bar employees, 3 times that it results in a revocation of the liquor license. that pretty much means out of business.

Same idea here, though as I understand it the burden is to show knowledge or willful ignorance + inaction, whatever number the situation demands.
