If this were you or me, and we did this in NEW YORK of all places, we'd be prosecuted like there was no tomorrow for killing another cop... This kind of shit is why some people resent the popos. Personally I don't love or hate them, but I can see why some people feel that way about them. I'm surprised he didn't manage to shoot the guy's dog while he was killing people. Notice the article says it "accidentally" went off. Why doesn't it say he "accidentally pulled the trigger with rounds inside the freakin gun???

A rookie cop who accidentally shot and killed his best friend Wednesday night likely won't be charged criminally but may face departmental discipline, according to law enforcement sources.

As Javier Colon, 25, a police officer for less than a year, tried to unload his NYPD-issued Smith & Wesson 9mm handgun around 8:35 p.m., the weapon discharged a bullet that struck his friend, George Perez, 25, in the head. Despite Colon's effort to save him, Perez died 25 minutes later.

The rookie cop, who was assigned to the 75th Precinct in Brooklyn's East New York neighborhood, was placed on modified duty yesterday - his gun and badge were taken away and he was assigned clerical duties - while the New York Police Department and Brooklyn district attorney's office investigate.

However, a law enforcement source, speaking on the condition of anonymity, said a preliminary investigation shows the incident to be a "tragic accident." Officials at the Brooklyn district attorney's office don't anticipate charging Colon criminally or presenting the case to a grand jury, the source said.

The NYPD also will investigate Colon to see what, if any, departmental procedures were violated. One source said that at a minimum, Colon could face punishment for failing to safeguard his weapon.

The fatal accident unfolded within a matter of minutes after Colon, Perez and a third friend arrived at the friend's Dyker Heights home to play poker.

The three friends had met in Manhattan then traveled to the man's home at 1262 81st St. Because guns make his friend's wife nervous, Colon went to the kitchen intending to unload the gun and store it in a cabinet there, according to law enforcement sources.

Police said it appears the gun went off as Colon was removing the bullets. As the gun fired, Perez, who was coming from another room, was struck in the face from a distance of a few feet.

Colon screamed out that he had shot Perez and yelled for one of his friends to call 911, police said. The rookie cop then tried to render first aid. When police arrived Colon told them he had shot his best friend. He also identified himself as an officer, police said.

Perez was taken to Victory Memorial Hospital, where he was pronounced dead just after 9 p.m. Officials said Perez lived in West New York, N.J., with his wife. The couple didn't have any children.

Police said the men had taken beer to the home but hadn't drank any of it before the shooting happened and that none of the men had been drinking prior to the shooting.

Very disturbing........ Anyone else in the civilian world would have been prosecuted and served time... Its sad to see how two faced our gumberment has become......
