So, lets say they end up arresting someone for anything... You get your day in court (Hopefully). My nonlegal mind would immediately contest it as an unlawful arrest. When asked why, simply ask for the arresting officer FLETC certificate. If someone can get off a DUI because a machine isn't calibrate. You would think having unqualified arrest powers would get it thrown out.

The way I read it and I could be wrong but it doesn’t apply to the National Guard. It also doesn’t mention the Navy or Marine Corps.

Edit: it looks like the act does apply to the guard in this case. To not be included, the national guad would have to be doing state business, so I was wrong in that regard.

“The Posse Comitatus Act (PCA) does not apply to the U.S. Coast Guard, or to the National Guard in Title 32 or State Active Duty status. Although the PCA prohibits only the Army and Air Force as from performing domestic law enforcement activities, another statute, 10 USC Section 275, requires the Secretary of Defense to prescribe regulations to prohibit members of the Army, Navy, Air Force, or Marine Corps from direct participation in a search, seizure, arrest, or other similar activity unless participation in such activity by such member is otherwise authorized by law.”

Nope.  They will have the authority to arrest as a special deputy, but pretty much they will just detain and let an actual federal agent take everything from there (which is much more involved).
