A person is justified in using deadly force against another to protect land or tangible, movable property:
(2) when and to the degree he reasonably believes the deadly force is immediately necessary: (A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime (Night time is 30 minutes after sunset until 30 minutes before sunrise). Is a statue "land or tangible, moveable property" seems like it's immovable property, also seems to only apply after dark if you are calling it criminal mischief |

Seriously, is this up to and includes deadly force? Generally, you can only use enough force to stop the crime, and no more. Also, is this an affirmative defense? Do you need to prove the force was needed, or does the state need to prove deadly force wasn't needed?

Yeah, stuff like this is one reason, among many, that we need to increase the educational requirements for police officers and police academy instructors in Texas.
I'd suggest we begin with the basics, like reading comprehension. Then, we can transition to more complex topics like the definition of movable fuckin property. |
