Do I have to have residence in TX or can I just be there visiting?
|
|
I'm going to with nope. *unless you are shooting a thief who is stealing an already torn down statue out of your own vehicle*
Still, it's not a TERRIBLE image to plant in rioting vandals minds. Fuck with Texas, get shot. That's pretty straight to the point. I have ZERO plans of being anywhere near a mob of communists or fascists so I will not have to worry about leaning on a facebook post to stay out of prison. |

The problem I see is that it is neither your property nor property that the owner wants you to defend. If it was at night, then criminal mischief at night comes into play. UT owned the statues it moved, so that was a gimme.
Nw the cop was right to one point. Good luck getting a jury to convict the shooter in Texas. |

A person is justified in using deadly force against another to protect land or tangible, movable property: (2) when and to the degree he reasonably believes the deadly force is immediately necessary: (A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime (Night time is 30 minutes after sunset until 30 minutes before sunrise). Is a statue "land or tangible, moveable property" seems like it's immovable property, also seems to only apply after dark if you are calling it criminal mischief View Quote |

Not one I'd want to be the test case for, but it's an interesting idea.

I don't think the ol' boy's interpretation is cogent...unless it's after dark...then the 'Mischief in the Night' thingy kicks in.

Phuc yeah!!
Let's get some tree stands deployed around these statues and monuments PRONTO |

Seriously, is this up to and includes deadly force? Generally, you can only use enough force to stop the crime, and no more. Also, is this an affirmative defense? Do you need to prove the force was needed, or does the state need to prove deadly force wasn't needed? View Quote |

Do you need to buy tags and is this considered hunting over bait???

So if someone shoots a vandal will the police not investigate the shooting since no crime was committed?

By my read, it wouldn't be legal as a statue doesn't strike me as land or tangible movable property. And even if it was, deadly force would only be permitted at night. I'm not a lawyer, though. Y'all feel free to be a test case on this one. Imma sit this one out. View Quote |

It's not about the statue, it's about what it represents. Some folks believe ideas (and heritage) are worth fighting for. View Quote View All Quotes View All Quotes |

Yeah, you can protect your property "at night" with deadly force. Someone breaking into your car to steal change? Yep.
|
|
|
Deadly force could only be used at night. During the day I believe you could use force (i.e. punching, taser, pepper spray).
Obviously, this would only apply to Antifa types, you couldn't use force or deadly force on government workers acting on orders from the government to remove statues. |

Is this going to turn into another guard post like the recruiting stations were for a while?
I can just see the ND's coming. |

I wouldn't shoot someone vandalizing a statue. I would be OK with the cops doing it.
