I am pretty sure we have covered this one before.  But now there is video of the court proceedings fighting the ticket.   Cliff notes:  Guy has car running in driveway to warm up..... cop drives by and sees it running unattended and stops and writes a ticket due to public safety concerns.   "Someone could steal it and speed and hurt someone!!" paraphrasing the police chief.      But the officer doesn't knock on the door or notify anyone in the house that it is an issue.   So it couldn't possibly be a true public safety issue because he left the car in the same condition he found it only with a ticket on the window.  

   The icing on the cake was the judge chewing out the defense lawyer for the info ending up on facebook without the judges express consent.   Apparently someone in attendance at a previous hearing was livestreaming the case on facebook.    The Defense attny knew it had happened (but wasn't doing it personally) and the judge flips out and puts him in contempt of court.     I think for transparency sake all court cases should be available to be recorded if the defense or prosecutor wishes.   Helps keep the courts honest.   Sure you can get transcripts but that doesn't show obvious contempt, snarkiness, or possible bias in peoples actions during the case.

This reminds me of a funny story.

My wife's cousin was stationed in Colorado about a year ago, he's from Louisiana. So he buys himself a car while he's there and one morning he starts up his car to warm it up. While it's warming up and he is inside, someone jacks his car. Gets better though. He calls the cops and when they get there he explains what happened. In the end he got a ticket for having his car running to warm up and never got his car back. Lol kick a man while he's down!

Since it is Michigan in the winter..... I wonder if this officer is trespassing on everyone's yards to check running vehicles in case a few of them don't have remote start and are a threat to the general public?

How did the court know this guy left his car idling?  It could have been his wife or kids. 
I suspect that he admitted his "crime" to the police. 

If the cops knock on your door, asking whether you left your car running, the only correct response is: "am I being detained?"

My research indicates a different situation:


LANSING, MI - A portion of a little-known Michigan law that made it illegal to "warm up" a car in a driveway has been reversed by state representatives.

The Michigan House of Representatives approved Tuesday afternoon, May 2, a bill that will allow motorists to leave an unattended vehicle idling in a private driveway without fear of a ticket. The legislation kept in place the regulation against having an unattended vehicle idling on a private roadway or business parking lot.

House Bill 4215 moves to the state Senate for consideration before it can become law. It passed through the House's Transportation and Infrastructure Committee in March.

Michigan's law against "warming up" an unattended car in a driveway grabbed headlines when a man in Roseville received a ticket for "warming up" his car in his driveway in January. A month later, the Muskegon police chief announced that his department would be cracking down on unattended vehicles idling in city driveways to help combat the possibility of the car being stolen.

Despite concerns raised by the state representative who represents the Roseville area, the legislation passed the full House on a vote of 77-30. State Rep. Holly Hughes, R-Montague, sponsored the bill.

I wouldn't be so stupid as to start my car in the drive way or anywhere else, and then get out and go into the house. That's an engraved invitation for a thief to steal it. Who does something stupid like this. However, stupidity shouldn't be subject to traffic fines. Unless it directly affects others negatively.

  Remote start does not require the key to be in the ignition so the column is locked and once the brake is applied without the key in the ignition the car shuts itself off.  It would be as hard for a thief to steal without the keys whether it was running or not.  

  If you are starting the car and leaving it running with the keys in the ignition I think that is foolish but if it is done on your private property I think the "state" should fuck right off.

A couple summers ago, I was driving from Midland to Ft Worth for the weekend and had my dag with me. 

I stopped at a quick stop to grab a coke, left the AC running for my buddy, and all the doors locked. 

When I came out some crazy lady jumped my shit about leaving my dog in the truck with the windows rolled up and how he'd die in 5 minutes time. I told her the truck was running and the AC was on...and she looked like I really deprived her of her social justice crusade for the day. 

I loves my remote start key fob.

No, Roseville passed that law. The house voted to let people warm their cars up as did the senate. Looks like Snyder got it six days ago. HB 4215  Uniform Traffic Code

Looks like I was beat to the punch. Added the Traffic code so you can see the part that was taken out if you read the bill.
