Obama outlined his thinking in a guest posting on SCOTUS blog Wednesday:

“A sterling record. A deep respect for the judiciary’s role. An understanding of the way the world really works. That’s what I’m considering as I fulfill my constitutional duty to appoint a judge to our highest court.”

Obama is president until January. McConnel will wait until after the election. Then, on like November 15 or something, they'll let through whoever Obama wants so as to not be "obstructionist." Then Obama will swear him in and leave office. Thy have almost 3 full moths t cave and still fulfill the promise of "waiting until after the election."

The Constitution says "... he shall nominate and by and with the Advice and Consent of the Senate, appoint...." not just "appoint."
