So we are sitting here discussing by association crimes and it came up the subject of death with a violent crime.

So I said,  to her, if i was with you and we robbed a store together and I got shot, she could be charged with 1st degree murder.

She said no.. I say yes.  

This is true correct? I have seen it happen however I can't provide examples of this fact.

Could you help or disprove this?  

What is the most correct answer?


ETA:  Thanks to you guys she backed down and said she was wrong!!

She apologized and is at this moment 2313 pac time, refilling my Jack and coke.

there was a story i remember a few months ago, where some guy was waving an unloaded gun around in a bar.

cops shot him, some bullets missed, one struck and killed a woman.

perp (waver of unloaded firearm) survived and was charged with murder

It's called "felony murder" and yes, you're correct.

Yes, and this is probably why the piece of crap that was stealing cigarillos with Mike Brown immediately told a lie about the shooting. "He shot him in the back with his hands up!"

He in Cali, if anyone dies while committing/fleeing a crime, the surviving criminal can be charged with the death even if it was a cop that killed him.

Nope. Felony murder.  The justification for the sentence is that the death would not have happened if the crime hadn't been committed.

Let me clarify (and CMA): This is a POSSIBLE sentence . Most any lesser sentence is possible, too, depending on the court's guidelines, which will vary from one location to another.

If the "clerk" of the store was killed, it's felony murder.  But if s co conspirator is killed it wasn't ?

I remember this from bar prep but in my practice now I have never ran into it.


After I passed the bar I threw all of my bar prep away so I have no clue if I'm remembering correctly.  In wv (at least), it seems that if anyone is killed during the commission of a felony A charge of felony murder can be triggered.
