Anyway Geert Wilders was found not guilty for the crime of insighting hate against the Muslim community.
The thing is as a lawyer I would say that he should be found guilty by the letter of the law (the law itself is a violation of the right of freedom of speech and sucks ass all round). But I think the judges noticed that a guilty verdict would just cause a whole lot of shit here. Anyway BBC story in English |

I'm glad to hear he was not convicted. I hope he continues to speak out. This is a small victory, but a rather pleasant one.

The fact that such a charge can be made in the first place is disturbing. After that, whether they find you guilty or not seems irrelevant. |

Well a couple of minority groups (who made the original police complaint) have now declared they will be taking the case to UN's humanrights commission, so que the UN helmet pic.

My Father-in-law grew up, and still lives in Holland. He is here in the states right now, and he thinks that Wilders may be the next Prime Minister.

as a lawer don't you think the judge had an obligation to find him not guilty since the law is unconstitutional?

Judge : "Mr. Wilders we find you guilty of inciting hatred against the muslim community." (half the court cheers) "However in the spirit of tolerance we fine you 500 euros only and let this judgement stand as a symbol that hatred has no place in a western democracy" Mr Wilders: "I refuse to pay 500 euros." (the other half of the court laughs) Judge : "Very well then, in the spirit of unity, I will reduce the fine to 1 euro." Mr Wilders: "I refuse to pay 1 euro............DOM KUTJE! !" (the whole court goes: oooooooohhh no he dint!!!) Judge: "Very well the fine is waived" At that point a bunch of men with bright orange beards stand up "Arrrgh!! He no pay fine??!! WE KEEL YOU FOR SAYING MUSLIM NO PEACE FULL!!! Kaaafir!!! The end. |

No he was found not guilty of the matierial crime of offending Muslims, the judges got out of this one by saying his comments were aimed at the religion Islam but did not offend individual Muslims. I't was legaly a BS argument but it offered the judges a way out. There are really no constitutional protections, in the Dutch legal system the constitution has a bit of a strange position, and is seen here more as a guideline for lawmakers that actual law a individual can use. A Dutch judge for instance can't find a national law unconstitutional so the constitution is pretty much useless Thats also why I am so intrested in the mechanics of the US constitution and BOR. |

They tried to convict Mark Steyn and Ezra Levant of hate crimes crimes against their made up little law, and they said "I'm guilty as hell, convict me". They wouldn't do it. Political correctness is a passive/aggressive disease. It is more important for a hate crime law to survive intact than it is to make a point - so if high profile offenders have to be let off the hook in the name of "freedom of speach" in order to preserve the law to go after low profile offenders- so be it. The witch trials are used to demonstrate "how fair" the law is Your mileage may vary at your witch trial As long as any hate crime law is on the books, Liberty is in danger. Luckily, these laws may be on their way out in Canada. Hope the Dutchmen are of the same mind. |
