Illinois spring breakers jailed for booze
By Stephanie Nelson (Contact) | Andalusia Star-News Published Tuesday, March 9, 2010 A minor traffic infraction turned out to be a major felony incident for six Illinois spring breakers after they were caught with 10 cases of beer and eight cases of assorted liquors Sunday. Lt. Lance Price said agents with the Alabama Beverage Control Board were called to assist the Florala Police Department when the officer located the alcohol inside the group’s vehicle. “What many people don’t know is that it is illegal to possess and transport alcoholic beverages through a state they have not purchased it from,” Price said. “It is also illegal to possess five gallons or more of such alcohol.” Price said 52, 12-ounce beers constitutes five gallons of alcohol. Arrested and charged with transporting more than five gallons of alcohol were: Jona Bertsche, 22; Troy Bertsche, 23; Josh Decker, 22; Tim Iverson, 23; Kyle Harding, 24; and Erick Smith, 23. Each were booked into the Covington County Jail and held on a $10,000 bond. Unless there is some sort of intent to sell, I find part of that hard to believe, especially since you can bring duty free booze into the country. |

Where they reselling to underage drinkers? If not, and these six guys (all over 21) face a "major felony incident" then something is terribly wrong in this country |

Are these Alabama only laws or are these some type of federal law? The article made it sound like it was illegal to do this in all states. If it is, I guess with the amount of wine and alcohol that I have in my home I'm commiting a felony!

This is what the ATF says about removing it from the premises. Sec. 25.206 Removal of beer Beer made under Sec. 25.205 may be removed from the premises where made for personal or family use including use at organized affairs, exhibitions or competitions such as homemaker's contests, tastings or judging. Beer removed under this section may not be sold or offered for sale. (Sec. 201, Pub. L. 85-859, 72 Stat. 1334, as amended (26 U.S.C. 5053)) Sec. 25.207 Removal from brewery for personal or family use. Any adult, as defined in Sec. 25.205, who operates a brewery under this part as an individual owner or in partnership with others, may remove beer from the brewery without payment of tax for personal or family use. The amount of beer removed for each household, without payment of tax, per calendar year may not exceed 100 gallons if there is one adult residing in the household or 200 gallons if there are two or more adults residing in the household. Why would you buy it there and haul it to some place where you could actually buy it cheaper? I have a feeling some lawyer will make this go away for the low low price of several thousand dollars. If you are not consuming it in the states you cross, I don't think you have to pay taxes on the stuff to those states. |

It's another example of old laws that should have been purged decades ago but have stuck around for the sole purpose of screwing with innocent folks.
DC has a similar bootlegging law, only it's half a gallon. Want to give your friend a gift of a 12-pack of beer? Maybe taking it to his house for a party? If he lives in DC and you bought the beer in another state, that's a felony. Where it gets really funny is if you make it yourself. It's perfectly legal to homebrew and it's also legal to give it away in most states. However, transportation of alcohol that has not had tax paid on it is a huge no-no in some places. It's all a very strange shell game and nobody is really certain of what all the laws are. |

Spring Breakers on Padre Island. The black drum and redfish are running hot around the rigs right now and I was hoping to head down Monday thru Thursday. Spring breakers means a 4-hour wait for the ferry and guaranteed car burglaries amongst other things. |
