Some peeping toms using a remote camera to violate people's privacy on private property got their activity interrupted. You don't say. Sounds like a good shoot. Rifle vs aerial target at the live pigeon shoot.... Henry Bowman is alive and well.
Anyone else besides a left wing wacko group would be charged with wiretapping, stalking, or whatever other charges the local prosecutor could come up with. |

So property rights.
How much airspace does a property owner 'own'? Would the property own be required to allow the owner of the ROV go onto his land so he can recover his downed ROV? I know as a kid if we hit a baseball into someones yard we'd ask the owner if we could retrieve it. If we were too chicken to ask the owner, we'd consider that ball forfeited. |

English common law provided that the owner of fee simple title owned from the center of the earth up through the property line and into the air. They couldn't get very high in those days but I think we could safely assume that the answer is "high enough that it doesn't matter" in the case at hand. I'm not sure that modern jurisprudence has ever actually ruled on the issue of airplanes which are technically tresspassing whenever they are over private property in states where the law is based on common law. Regardless, unless there is some aspect of PA law that I'm not aware of I think we can safety assume that if they fly the thing across the property line they have at least committed a civil tresspass if not a criminal one. There is also the issue of possible eavesdropping and/or wiretapping statute violations depending on the way PA law is drafted, and this would likely be a lot more serious. |
