Federal Court Strikes Down NFA Registration on "untaxed" firearms (Page 185 of 194)

Many of you are expressing confusion in this thread about membership numbers, cards, etc. It took me about 15 years to get my card. My membership number was on the "please donate" mail GOA sent me so I did have that. I called once, got ignored, called again about 18 months later and finally got a card. GOA is a very effective TKBA organization because of it's structure. It is on it's ass when it comes to member services because of it's organization. GOA is a California non-stock 501(c)(4). It's board and executive leadership is selected by the board. The founder, H.L. Richardson, picked the original board members in 1976 and original executive director Larry Pratt. When Richardson retired, the board picked Tom Macy, an original board member (no clue how old he is). When Larry Pratt decided to become "executive director emeritus", his son Erich became the executive director. The board doesn't have to replace members (Sam Paredes, the secretary / treasurer died in 2025 and the board didn't replace him). Because of this very tight, stable board structure, GOA has a single focus. It's totally different than the NRA, which has a large board, elections, member input, etc. GOA is an effective organization, but it's not a member-focused organization. GOA doesn't compromise because the tight, closed board doesn't answer to anyone except themselves. The difference between GOA and the NRA 2.0 is you will never know what GOA is spending money on. As I said "GOA doesn't compromise because the tight, closed board doesn't answer to anyone except themselves." GOA has been very effective but unless you're on the closed bard or a Pratt, we're all just paying money to be along for the ride - we aren't in the club. |

Yeah it's one thing to make a silencer, decide you don't like it and then sell it in a private sale. It's another thing to have an NFRTR-registered silencer, sell it, notify the ATF that you no longer have it and ask them to please record it as no longer in your possession, and then have the ATF affirm that they've done so. |

The injunction IS the guidance. Well said, Dominion. You are correct on the recreational marijuana issue at the federal level. DEA doesn't seem interested in that part of the business however, there are some "international interests" if you catch my drift, that they ARE interested in, something the legal dispensaries are NOT part of. When it comes to dispensaries acting within State law, those they ignore though they are in violation of the Controlled Substances Act and could be subject to penalties under 21 USC 844. I've linked both below. For the room; remember who the ATF director is, and those currently leading the DOJ. Director Cekada is a cop's cop. Doesn't surprise me he's taken the "DEA model" in not putting out "guidance. I'm willing to bet he worked closely with the DEA and is quite familiar with these issues and how they both have similar legal issues. The court case IS the guidance. If you have any questions, call a lawyer like the rest of us do for CORRECT legal advice. DEA CSA 21 USC Sec 844 |

Just because you keep saying NC is breaking the law, doesn't mean you are correct. Here are the exact words of the "Texas Judge" on page 1 of the ruling: Remedy-wise, the plaintiffs in both cases are entitled to a permanent injunction barring enforcement of the challenged NFA provisions against them, their members, and their customers. But that is as far as it goes. Federal courts lack power to issue universal injunctions that provide relief to parties not before the Court. https://foundation.gunowners.org/wp-content/uploads/177118845368-1.pdf NC has a history of screwed up firearm laws and plenty on the books that need to be struck down or removed. However, they were not a party to this case, so the injunction doesn't apply to NC state laws |

Despite some people claiming differently, the 4473 form is not a registry. The NFRTR is. It's actually an interesting situation for people wanting to sell a suppressor FTF and also feeling the need to notify the ATF. The ATF is enjoined from maintaining the NFRTR for covered parties. So if you sell a suppressor FTF and then ask the ATF to remove it from your inventory, they could reply "Sorry the court won't let us do it". If you are comfortable enough with the injunction to sell a can FTF you should also be comfortable enough that the NFRTR is legally dead, amd anything listed as belonging to you in it is meaningless. |

In my case it turned out that my order was hung up by Silencer Shop's system requiring me to do a few steps to register with them. At that point in time - even if they could have shipped right then and there - it would have been highly unlikely that I could have recieved and completed a transfer on the cans while I was still in the US so I asked for and got a refund. The guy I was replying to in e-mail was super helpful, replying within minutes each time and even requesting my documents proving my .mil connection so I can get a discount when I do order in the future.
