Personally, I don't believe anything that
BenDover has written about his alleged run in with the Patriot Act!
He has not given any answers to the questions which I posed to him earlier.
Which basically asked him how his case differed from a criminal case 100 years ago?
An answer should have been on the tips of his lips!
He's had plenty of time to think about his answer and to cite what was different in his case from a kiddie porn case in the 1960s!
Or a federal tax evasion case in the 1940s!
A citizen was charged with a federal crime, he or his attorney desired to obtain evidence from a third party (in this case,
Ben), and that third party was compelled under subpoena to testify in a court of law in the criminal trial and to produce certain physical evidence and records.
Ben was given ample opportunity to quash or 'ignore' the subpoena and filed a motion to do just that, which a federal judge reviewed and said, 'No.'
No appeal of that judge's denial of
Ben's motion to quash subpoena was taken, and
Ben testified in the trial/hearing and produced evidence.
Nothing related, so far, by
Ben, would have been any different than had the case been a criminal case filed in the United States at any time in the late 18th, 19th, 20th, or 21st Centuries.
And, yet,
Ben wants to blame his recent legal difficulties with The Patriot Act!
And, thereby, on President Bush!
That is so absurd as to defy an easy explanation.
