Are NICS checks required when the person getting the gun has a valid CCW?
Does anyone know the answer and where to find the law on it. I have heard and read both yes and no. Any FFL holders here sell to CCW without NICS? Does this vary between states? Thanks |

In the State of Florida they still need to do the NICS check because CWL here falls under purview of the Florida Department of Agriculture and Consumer Services which is not a law enforcement agency.
But we do get to have Charles Bronson sign each and very one of our CWLs. 
BTW; in Florida it's called a Concealed Weapons License because with one, we can carry all sorts of concealed weapons in addition to firearms. |

Be advised that even if your state does recognize a CCW in lieu of NICS that doesn't mean that a dealer has to waive the background check. It means the dealer has the OPTION of waiving the NICS check. In states where it is approved it is an "alternative", not a "must".
Wal-marts here put EVERY BUYER through NICS regardless of CCW. |

| It also depends on the shops some times. I've been pissed at all of the local stores because FL statutes says my CCW means I pass the background check and then some. However the local shops run NCIC on LEOs and CCW holders. The closest guy does not charge me for them though. |

I just learned that holding a CHL (Concealed Handgun License...an Oregon term) does not negate the need for a NICS check at the time of purchase in Oregon... picked up a new XD last week, and was surprised to learn this. Must have been a fairly recent change here.
