Page 8 under legal notices. All claims for property must be made by May 25th or the property will be disposed of according to ..... . Has hundreds of guns listed - machine guns, everything. Time for another Cav arms purchase.... This is some bullshit!!!!!!!!!!! Hopefully Cav has a lawyer or two on it, and a buyer lined up to recover assets. If anyone other than Cav or thier designate buys, I would be interested in knowing who it is... so they can be black balled in the future. No Love. None. S-28 |
Well now that the ATF has made public notice, Cav can start the process to get all their stuff back. The ATF will of course drag their feet. |

I just tried the WSJ's online legal notices search, and it's not listed there yet. Maybe it'll be available online tomorrow. Can any lawyers here guess as to whether this means it's officially too late for them to get the property back, or can they still try to claim it before the sale? |
I would like to know myself. My guess would be that the Feds can take it if they claim it was made/bought or whatever from illegal activity There has to be some smart guy lawyers on this site that can give some info |

A judge has to rule on the action and approve it, after the lawyers haggle. Or, the person signs over the assets. |
Gee, think it might be because drugs are illegal and drug dealers are BREAKING THE FUCKING LAW when they sell them? Anyone who can't see the difference between a guy dealing meth on a street corner and a firearms dealer selling legal weapons from a store front have been smoking too much of their own product. The People give a law enforcement agency the power to take assests from known criminals, if they use it against non criminals that doesn't mean it was wrong to grant the power, it means the agency responsible is abusing the power and needs to be slapped down. |

I noticed the WSJ notice. ATF has been publishing these for quite some time. Most of the time, the listings are small. When they include machine guns with no serial number, it is easy to see why they confiscated things. Not so easy with Cav Arms. I have 52 year old eyes, and I needed a magnifiying glass to read the list. My father raised me to be a proud American. Sad to say, I have af hard time doint that right now. Even he would have found the entirej Cav Arms situation ridiculous. |
The fact they crafted a law this bad deserves criticism REGARDLESS of who it's used on. AF laws are a bad fucking idea. Giving a PD/Gov a way to profit off of a crime drives them to find AND use new ways to find the revenue. |

Absolutely unfucking beliveable. WTFO Isn't this evidence in an ongoing investigation? If that investigation turns up nothing, why isn't the property which was seized in error returned? How can they kick in the door, seize property, then attempt to dispose of the property without the consent of the owner. WHERE IS CONSTITUTIONAL PROTECTION OF THE RIGHT NOT TO DEPRIVED OF PROPERTY WITHOUT DUE PROCESS!?!? It's not fucking "ABANDONED" property. If they contact the owner, and get no response, THEN, it is abandoned property. Un mother fucking believeable!..................  Gotta go re-read the preamble to the Declaration of Independence now... |
It's possible because the legal process for forfieture has been invoked... The ATF can't just take the stuff, they have to follow a process which includes posting public notice... Next, Cav gets a chance to win their stuff back in court... |

They are getting their due process under current law... The forfieture proceess starts with the siezure.... Since the case for forfieture is made against the PROPERTY ITSELF, things get wierd from there... A public notice is posted WRT the siezed property, and the owner is offered a chance to claim/redeem it (by showing in court that it was not part of/proceeds of illegal activity)... At this point A GOOD AMOUNT of siezed property DOES become 'abandoned', because the owners KNOW that it *was* involved with illegal activity (See drug runners busted with car-doors full of cash)... However, in the case of Cav, they very well *may* be able to redeem it... I say *may* because the charges/info against them (IIRC) has not ever been released.... |
