Word is out that out very fine State Legislature is about to announce anti-gun Bill(s) very soon.

STEP ONE is to obtain contact info for your State Reps and Senators.  Contact Town/City Hall for exact info, or search on web at RI Secretary of State site: https://sos.ri.gov/vic/  

If your Rep or Senator is on the Committee hearing such bills, start writing NOW!  In fact, do so even if they're not your Sen/Rep.

STEP TWO is to cajole/persuade/beg as many like-minded folks to also send cards and letters to RI State Senators and Reps.

Signed, personally written cards and letters are WAY more influential than e-mails.  Even just a dozen cards/letters on a single issue have influenced legislators in the past.  Be polite, be brief, and let them know you are a VOTER, and are watching them.

STEP THREE is to get ready for a possible trip to the RI State House for Committee hearings on such bills.  Like it or not, your personal appearance makes a difference, so leave the camo and patched Club jackets at home!  Suits and professional attire make a good first impression, and you get only one chance at a good first impression.

ETA: Newport had a meeting in City Hall on 14 Feb to discuss proposed City anti-gun resolution.  Pictured in Newport Daily News next day, in large, 4-column, above the fold color pic is some guy wearing a camo hat, OD sweatshirt, and woodland camo rain parka.  Behind him was another guy with a "Don't Tread On Me" coiled snake logo on his ball cap. Anti-gun resolution passed.

STEP FOUR is to mobilize articulate women in our cause who are willing to go and be seen/heard in person at the State House.  I can tell you for a FACT that one articulate woman or minority member is worth five or more white men.  While this might sound racist/sexist, it is a FACT of life.

I have been through all this before back in '94, so rest assured that I know what I'm talking about.

We have a long and difficult battle ahead of us here in RI and we need to get our voices heard now even before the bills are introduced. We need to rally friends, family, sympathetic strangers and even each other now and in the future if we have any hope of suppressing what these dim-witted, so-called politicians are capable of stripping from us.

I agree that letter/card writing gets better viewing than emails and if you want to go one step further (especially on a federal level) faxing your letters will be read for sure. The advantage to faxing is that there is no time/energy/money spent checking the envelopes for foreign substances.

However, there's something to be said for the ease of emailing en-mass and here's a listing of all Rhode Island's representatives and senators. There are no semi-colons between the email addresses as that works with my email software (Mozilla's Thunderbird). You might have to go through and add semi-colons for it to work with other clients. Sorry.

Because RI is such a hotbed of gun violence.  

Seriously... this shit is bigotry, plain and simple.  It is driven by fear and hatred.    If laws were passed based on fear and hatred of any ethnic or religious group, there would be a national outrage.   But because it is an inanimate object, or a man who owns one, it is fine.

America, please find yourself again.

This whole business is a numbers game at this point.  Simply put, the more cards and letters your legislators get [b]AGAINST/b] Anti-Gun Bills, the better.

MAKE SURE to tell your State legislator that you vote, and so do your family members.  Don't tell them how many; let them guess.

Those cards and letters NOW help insulate your Legislator from taking a stand in favor of such bills now, that they might find embarassing to retreat from later on.

Head them off at the pass, and make sure they know that there is PLENTY of opposition to Anti-gun Bills in RI.

Numbers mean EVERYTHING at this point.  Keep those cards and letters rolling in!

I received the following from Representative Mike Chippendale. He is a very pro gun republican representing Coventry, Foster and Glocester.

I do not have any inside leads from the senate side of the assembly, but hopefully that will change soon.

Please keep those letters and emails going out. If possible have your wife, girlfriend and/or femail friends sign some as well as I've heard responses from females count more. I think this is important in light of the fairly recent attack in Georgia when a mother and two daughters were attacked in their home and the mother shot the assailant six times and the assailant walked away.. If this isn't an arguement for full capacity magazines I don't know what is.

01/30/2013 Introduced, referred to House Judiciary

This bill would prevent anyone under the age of 18 for merely possessing a firearm. This would make every law-abiding citizen under the age of 18 a criminal for exercising their 2nd amendment rights. It would violate our own state’s hunting laws that allow minors 12 years old – 17 years old to enjoy the sport of hunting. It would also impact Boy Scout events, and all other currently legal activities.

The intent is to stop gangbangers who let minors carry their firearms in the event they are confronted by the police because minors face lesser penalties.

Status: Introduced to House Judiciary on 1/30/2013, no hearing is scheduled at this time.

Support: This bill is not supported by the Rhode Island 2nd Amendment Coalition, the Rhode Island State Rifle and Revolver Assocation, or the NRA


Inside Info: I have spoken to the AG’s office and they will not be supporting this bill because they have been working with me on an alternative that will work to protect hunting, shooting and sporting activities that are being legally enjoyed by minors (see below). That essenially means this bill has little to no chance of even making it out of committee, but is still worthy of expressing your discontent to the sponsors.

This is the bill that I was working on with the AG’s office. Unfortunately while it started off in a very positive direction, this bill has been changed by the AG’s office into a form that I cannot support because it still turns law abiding minors into criminals. The AG has expressed willingness to continue working with me on a suitable SUB-A.

The intent is to stop gangbangers who let minors carry their firearms in the event they are confronted by the police because minors face lesser penalties.

Status: Introduced to House Judiciary on 2/14/2013, no hearing is scheduled at this time.

Support: This bill was just introduced, and I have no official notifications from any 2nd amendment groups, but I suspect there will be opposition from all of us.

Inside Info: I have spoken to key individuals who are working on the problematic sections of this bill to create alternatives that will not turn our good kids into criminals. If our changes are not accepted, then there will most likely be strong opposition to it.

Support: I support this legislation as I believe it makes campuses safer and can greatly reduce the number of victims in college campus shootings or other attacks. The intent is to force our law enforcement agencies to follow the rules that they themselves have played a large part of putting them in place. This bill was submitted because we learned that RI is one of only 4 states that do not enter names into the National Instant Background Check System of individuals that are denied the purchase of a firearm based on certain criteria – among them being mental health issues and drug and alcohol abuse issues.

Status: Introduced to House Judiciary on 2/6/2013, no hearing is scheduled at this time.

Support: As a co-author and co-sponsor, I obviously support this bill. The Rhode Island 2nd Amendment Coalition, the Rhode Island State Rifle and Revolver Assocation, or the NRA have taken no position on this legislation yet.

Inside Info: certain government agencies were not happy that we put this bill in because it made them look bad. Our position is that if they were doing their jobs correctly in the first place, then there would have been no reason to put the bill in.

ENTITLED, AN ACT RELATING TO CRIMINAL OFFENSES - WEAPONS (would require possessors of firearms to register those firearms with their local licensing authority, require that information provided in support of firearms applications be retained and maintained rather than destroyed)

The intent is to create a state firearms registration system for all firearms.

Status: Introduced to House Judiciary on 2/14/2013, no hearing is scheduled at this time.

Support: This bill was just introduced and I expect full opposition by the Rhode Island 2nd Amendment Coalition, the Rhode Island State Rifle and Revolver Assocation, or the NRA.

Inside Info: This bill is a clear violation of our existing laws and would be a tremendous step toward establishing the first step necessary for a gun confiscation program.

ANTICIPATED LEGISLATION:

Exter Concealed Weapons Permit bill: Last year Representative Larry Valencia entered a bill on behalf of the town of Exeter seeking to “opt out” of the Town-Level Concealed Weapons Permit system.  I was able to rally enough troops to kill this bill when it was introduced to the House Floor on the last day of session when the rules were suspended and anything in the world could have passed.

Intent: to stop the town of Exeter from issuing carry permits.

Status: I know that the town of Exeter has voted on this and is sending a resolution to Rep Valencia soon.

Support: This bill is not yet introduced but I expect full opposition by the Rhode Island 2nd Amendment Coalition, the Rhode Island State Rifle and Revolver Assocation, or the NRA.

Inside Info: This bill is a clear violation of the Constitution of the State of Rhode Island. Our constitution states that “the right keep and bear arms shall not be infringed.” There is a legal distinction between the words “may” and “shall”. Someone who “may” do something has discretion as to whether or not they actually do it. Someone who “shall” do something has no choice in the matter and must do it in compliance with the law.  There are two methods for obtaining a concealed weapons permit in RI – the first is to go through your police chief or town licensing authority. The law stipulates that they “shall issue” upon request and meeting the qualifications. The second is the Attorney General permit which is a “may issue” permit and basically can be rejected by the AG for any reason at all. In order to maintain the Constitutional rights of Rhode Islanders living in Exeter, this bill cannot be allowed to pass. It is an unconstitutional bill and must be fought hard be everyone. Exeter may not be your town – but once they get it in one, they will all go after it.

I encourage everyone to send me comments, questions, concerns etc. regarding the issues discussed in this email – or any 2nd Amendment issues."

I agree raf and just want to add that although I can't site my reliable source(s) I know that some key democrats in both the house and senate are on "our side".

That said there are still plenty of democrats that need us to keep hammering them with emails, letters and calls.

If anyone has any response from any general assembly member, whether positive or negative, please post the name here or in an IM to me and I'll forward the name(s) to someone who maintains a list.

In the meantime the following people are known to be fence walkers and can hopefully be swayed by our continued campaign.

Again, we need to keep pounding these people and don't let the letter after their name sway you. There are over 30 gun/sportsman clubs here in RI and I'm willing to bet that there are more than a few Dems that are members and value the importance of the Second Amendment.

Oh ... this was about 5 hours of work to send letters to ALL of the general assembly. I still need to pick up another roll of stamps before I send them out, but how long does placing stamps on them take and the stamps cost less than what a box of ammo is going for now.

I am not affiliated with the coalition in any way other than a supporter.

I just found out this evening that the lobbyist hired by the coalition to help protect our rights as gun owners is former Speaker of the House Bill Murphy. He supposedly is an assassin as he's killed every bill he's ever been hired to go against.

This does not mean that we should relax by any stretch of the imagination, but rather send another round of emails and place more phone calls. This battle is long from over and we need to make sure that our voices are heard over the useful idiot's voices that want to take away our rights.

With regards to contacting our elected representatives ... has anyone heard back from anyone whether through email or direct conversation?

Good news on Mr. Murphy, I met him at a function a couple of summers ago, great man.

All I have heard back from is Sheldon, Jack, and Langevin. Sheldon's letter was the only one that didn't immediately piss me off.

Right now, the most important things to do are
1) Write letters to the members of the committee(s) where the bills will be heard.  This is important so that the reps on such committees know there is a lot of sentiment AGAINST the Anti-Gun bills, and sentiment FOR Pro-Gun bills.  It is particularly important to do so if one of the Committee members is your Rep.  Let him/her know how you feel, and remind them that you will be watching them closely.  Remind them also that your vote, the votes of your family members, and the votes of your friends will hang in the balance, depending on their vote(s).  Make NO claims to numbers of votes you can influence; let them guess--and worry.  Have family members and friends write similar letters.  Right now, this is all a numbers game.
2) Write to House Leadership and voice similar sentiments as mentioned above.
3)Prepare to go to State House to attend committee hearings on the bills.  You need not speak at such hearings, and unless you are fairly polished public speaker, probably should not, BUT that is your call.  Leave camo, baseball cap, etc., at home.
How you look affects your credibility!  Numbers at such hearings are HIGHLY important!
4) Establish contact with the various Pro-Gun groups mentioned in this thread, and those in pinned thread atop this forum.  Go there often to get latest updates, and stay informed.

We CAN win this folks, but it will take involvement and work.. The greater the number of folks writing letters, the less the burden on each of them.  Again, it is all a numbers game right now.  NUMBERS COUNT in a small State such as RI, far more than most people think.  YOUR letter could be the one that makes your Rep reach the tipping point in our favor!  Send those letters ASAP!

The following is part of an email that I received from a state representative last night regarding correspondence. For what it's worth I still write letters as well as emails and make phone calls, but the following makes you wonder how much good the letters do.

As a Representative for the past 3 years I will tell you this - I watch the Reps line up at our mail boxes in the House and literally just take the envelopes and toss them in the trash. Not everyone does this, but enough of them do for me to recommend to folks not to write letters. You're unfortunately wasting your stamps and your stationery.

What DOES work is constant emails ASKING for a reply - such as, "I look forward to your response to I know where you stand on this bill and this issue." If they don't respond - send another email. Also - phone calls. These all work far better than letters and we need to encourage people to email and call the hell out of their reps and senators.

Also - when writing emails, each person should write the email in their own words and then send it off to all the reps and senators. No two people should use the same wording in their email. A lot of the community organization style groups use the "form letter" approach with emails and I'll tell you for sure that a custom written letter is a force multiplier.

I receieved the following heads up this AM. I am planning on being there and put in for a couple hours of Vaca to make sure I can be. I know this is during normal working hours, but guys if you can afford to go into work a little late, take a couple of vaca hours to do so, or hell take the day off--it would be great to see every Arfcommer from RI there.


On Friday March 1st at Warwick City Hall Mayor Tavaras is hosting a
summit of mayors and administrators from all cities and towns in Rhode
Island. The time is from 8:30-9:30 am.The subjects they will be
discussing are public safety,illegal guns and access to behavioral mental
health services.Also they will be conducting a thorough review of the
proposals being introduced to the General Assembly.
 Mayor Tavaras goes on to state that he" personally invites all
municipal leaders from across the state who are committed to this effort
to enact sensible GUN CONTROL legislation"
 Seeing as Warwick City Hall is a public building I believe members of
the shooting sports community should attend and let them hear our views.

 Also Mayor Tavaras has tentatively scheduled a "press event" for March
7th  at 3:00 to announce their joint efforts, including a gun buyback
program throughout the state. If your city or town becomes involved in
this program, you better question your municipal leaders where are they
getting the money from. Is it grants or are they using your tax dollars
that should be spent on what they were earmarked for in towns or cities
budgets. The gun buyback is scheduled for Saturday April 6th. If you hold
a FFL please show up at  these buyback programs with your license and
cash. You would be surprised at the type of firearms people are turning
in for a 100.00 or 200.00 gift card. You are not breaking the law as long
as you are federally licensed.

 Please forward to every person you can think of and show up to surprise
our so called "leaders"

"First let me state that I really appreciate all the support that folks have been expressing to those of us in the legislature who value the Constitution and the Bill of Rights. I also want to let you know that I spoke to several members of the Judiciary Committee and they are essentially crying “uncle” because of all the emails and phone calls they’ve been receiving. At one point I was in the hallway speaking to our outstanding NRA lobbyists from both Rhode Island (Elizabeth Clupney) and from Fairfax, VA, NRA HQ (Darin Goens) and while we were standing there two legislators actually came up to us and said “Tell them to stop calling and emailing – we won’t support the bill.” While they were both legislators that we knew would be on our side – it’s great that everyone is taking action on these bills.

My conversations with both NRA lobbyists were very productive. Darin really has his hands full with the 4 different states in his region, but he is still somehow managing to take care of business and make sure he is available to meet with legislators and other interested parties.  Elizabeth is also doing a great job with her grasp on the various bills and is looking into the future while also working on bills that have already been introduced, and even some that are not yet, but are expected to be introduced. Of course they are both working very hard behind the scenes by attending fundraisers for the various members of the Legislature to make sure they know that the gun owners of RI mean business!

Press Event/Rally

This Thursday the 28th at 2:30pm, my colleague Rep. Costa has reserved the Rotunda in the State House for a rally and press event to denounce the introduction of H-5573 – the gun registration bill.  I will be the primary speaker at this rally and we are really going to let our voices be heard.  I am asking everyone to attend this rally if it is possible to do so.

As you know there is strength in numbers and we need to let the media see that we are organized and we are not going to roll over and let legislators who completely disregard their oath of office by introducing un-constitutional legislation.

As always, make sure that if you do show up you come dressed in a non-inflammatory fashion (FROM MY COLD DEAD HANDS T-Shirts and stuff like that) and do not bring any signs that would be too controversial. The media loves that and will make the story all about the “radicals” in the crowd.  We need to beat them at their own game and show them that we are law-abiding, everyday Rhode Islanders.

If you are able to attend, please try to get there as close to 2:15-2:30 as possible. This will allow you time to park near the State House and still walk in on time. Remember – there is security and the public is not allowed to carry concealed weapons in the State House. Enter the State House through the Smith Street entrance, go through security, and then take the stairs in front of you, and then the next set of stairs will lead you to the rotunda."

On Friday March 1st at Warwick City Hall Mayor Tavaras is hosting a
summit of mayors and administrators from all cities and towns in Rhode
Island. The time is from 8:30-9:30 am.The subjects they will be
discussing are public safety,illegal guns and access to behavioral mental
health services.Also they will be conducting a thorough review of the
proposals being introduced to the General Assembly.
Mayor Tavaras goes on to state that he" personally invites all
municipal leaders from across the state who are committed to this effort
to enact sensible GUN CONTROL legislation"
Seeing as Warwick City Hall is a public building I believe members of
the shooting sports community should attend and let them hear our views.

Also Mayor Tavaras has tentatively scheduled a "press event" for March
7th at 3:00 to announce their joint efforts, including a gun buyback
program throughout the state. If your city or town becomes involved in
this program, you better question your municipal leaders where are they
getting the money from. Is it grants or are they using your tax dollars
that should be spent on what they were earmarked for in towns or cities
budgets. The gun buyback is scheduled for Saturday April 6th. If you hold
a FFL please show up at these buyback programs with your license and
cash. You would be surprised at the type of firearms people are turning
in for a 100.00 or 200.00 gift card. You are not breaking the law as long
as you are federally licensed.

Please forward to every person you can think of and show up to surprise
our so called "leaders"

Reports from State House rally indicate 500+ pro-rights attendees.  Pretty good turn-out on short notice  State House rotunda was PACKED!.  Lots of women, which changes the political equation from angry white men to a broader demographic, which will intimidate our Sens and Reps all the better.

As I said, this is a numbers game at this point. all those who write/phone/e-mail their sens and reps, and who attend rallies like the one today are playing a VITAL part in preventing asinine bils from becoming law.  This is NO time to let up!

Keep those e-mails, phone calls, and letters pouring in!  Every single one is added to the one before it.  Before long, it becomes an avalanche!

Ok Guys,

Report from the Mayors meeting. First of all I think I may have been the only Arfcommer, there were only 9 of us from the public that attended.

Second of all, the mayors had planned on this beng a private meeting. We got there @ 0830, the mayors filed in and then got back up and had a private meeting on thier own in the mayors office for about 40 minutes.

They then returned, and Mayor Tavares told us they had not intended the meeting to be public, and that they were planning on doing a gun buy back program. Questions of what the buyback was inteding to accoplish as well as where the money was coming from was answered. The moeny is from private company sponsors Gents.

After that they turned it over to hear from us. This is what impressed me. They took the time to listen to everything we had to say, no time limits, no interruptions, just listened and took notes. Many subjects were brought up for common sense answers/issues.

Mayor Tavares made a point of reffernecing everything we said back and forth to really hammer home that he listened to us. It was a good meeting.

There were obviously the mayors, but also reps, and Chiefs of Police from the different towns as well. I met some fine men today.

Keep up the emails and calls folks. I did not get even a hint that these gentlemen and ladies did not want to hear from us, if anything they made sure to tell us to keep calling and writing.

People, word is that the Governor, House and Senate Leadership/Staff, and various Police Chiefs have been quietly combing through existing RI gun laws with a view to adding to them.  You all can imagine the possible results.

What we have seen up to now is just the first skirmish of a long battle.

The main engagement has yet to happen, folks.

In a way, that is good, as we have had a chance to get connected with each other, and warmed-up a bit for the upcoming main event.

Make NO mistake.  With the support of the Governor and Legislative Leadership, plus various police Chiefs, the upcoming legislation will be all-encompassing, and it will take EVERY effort we can make to defeat it.

Keep those e-mails, phone calls, and letters pouring in!  and contact EVERY possible like-minded person to let them know their firearms rights and personal liberties are going to be on the line VERY SOON.  This fight is FAR from over.  Get your minds focused on the long haul.  Get connected, Get like-minded people connected with you, and Get Ready for the Big fight.

Exeter got boned big time, but it's not over. There's a petition to recall the four council members that voted for the resolution. IM me if you live in Exeter or know anyone who does and want to sign the petition. The lawyer says they (I'm not in Exeter) need 300 signatures. Once they get a new council in place Exeter can go back to the way they were.

As for this state ... hang on With the recent passage of the anti-gun bill(s) in CO Governor Gump and his minions are sure to come up with some major bullcrap in the near future.

The winds of change are a’comin’

Many members of Rhode Island’s shooting community are already painfully aware of the arduous process of applying for a concealed weapons permit in our state.  While it is certainly understandable that we would want to thoroughly ensure that the individual granted a CCW permit is qualified to carry a personal protection firearm, and not legally disqualified from owning a firearm in general, many feel that the current process is a bit on the side of “overkill”. Be that as it may, Rhode Island has two laws currently on the books that address the permitting process.

In layman’s terms there are two chapters, 11-47-11 – the Town Permit, and 11-47-18, the Attorney General Permit.  The ability to bear arms under these chapters is nearly identical with some very minor exceptions, and one tremendously important exception. I will not elaborate on the minor exceptions, but rather the important one.

The main difference between the two methods of bearing arms are two seemingly harmless words; “shall” and “may”. The piece that I’ve written below was used for testimonial purposes in the hearings in Exeter for a town council resolution that would seek to relieve the town of Exeter from executing her statutory requirements under Chapter 11-47-11. Reviewing this testimony will offer the reader a thorough understanding of the importance in the difference between the words “shall” and “may”.

When finished reading the “Exeter argument”, read on to learn of a new initiative being taken by the Attorney General to completely put your constitutional right to keep and bear arms in the shredder.

The Town of Exeter is seeking to have their responsibilities under Chapter 11-47-11 removed.

Why is this proposal unconstitutional?
What would happen if this became law?

#1 – We have the right to own, and carry firearms.
As residents of the State of Rhode Island and Providence Plantations, and citizens of the United States of America we enjoy the Constitutionally-protected right to “keep and bear arms.” This is a natural right which is protected in the Bill of Rights by the 2nd Amendment, and this protection is more plainly stated in the Rhode Island Constitution under Article 1, Section 22 as follows;

ARTICLE I
DECLARATION OF CERTAIN CONSTITUTIONAL RIGHTS AND PRINCIPLES

Section 22. Right to bear arms. -- The right of the people to keep and bear arms shall not be infringed.
(Emphasis added)

#2 – Where does the right to carry a firearm come from?

This right originates from our Creator who has “endowed us with certain self-evident inalienable rights” and one of the protections of those rights, is found in the same documents referenced above; the 2nd Amendment in our Federal Bill of Rights, and Article I – Section 22 of the RI State Constitution.

There are several key legal terms in Section 22 we need to understand to comprehend the full implications of the proposal in the town of Exeter.

“keep and bear arms” has been reviewed and ruled on by several high courts in the United States, and in fact; courts in all 50 states including Puerto Rico and the District of Columbia have ruled in the same way; the right to “keep and bear arms” is an individual right, not just a collective right, and in the context of the 2nd Amendment and all state constitutions which use the term “keep and bear”, it means “to possess, and to carry on one’s person”

Some recent court decisions that have been handed down over the past 10 years include;

1)  Washington DC vs. Heller   United State Supreme Court
         A)  The personal right to firearms existed before the 2nd amendment.
         B)  The 2nd Amendment protects weapons in common use by Law abiding citizens for lawful purposes.    
         C)  Entire Classes of firearms cannot be banned.  Semi Automatics or "Assault Weapons" are an Entire class.
       
2)  Chicago vs. Macdonald   United State Supreme Court
      A)  States and municipalities must abide by the 2nd amendment.

3)   Chicago vs. Shepard - 7th Federal District Court
     A) The majority opinion of the court articulated that "It is clear that the Supreme Court was protecting the individual right to firearms for Self Defense"
     B)  The Constitutional right to armed self defense is broader than just keeping firearms in the home, a person has greater need to protect oneself on the street than in
the home
     C)  A person has a right to carry a concealed firearm with a proper permit.
     D) The right to bear arms implies a right to carry a loaded gun outside the home.

#3 – Where in Rhode Island Law is the process for obtaining a Concealed Weapons Permit enumerated?

As Rhode Islanders, we have two means through which we can obtain a permit to carry a concealed weapon, hereafter referred to as a “Permit”.

The first means is on the town level;
§ 11-47-11  License or permit to carry concealed pistol or revolver. – (a) The licensing authorities of any city or town shall, … issue a license or permit to the person to carry concealed upon his or her person a pistol or revolver everywhere within this state for four (4) years from date of issue, if it appears that the applicant has good reason to fear an injury to his or her person or property or has any other proper reason for carrying a pistol or revolver, and that he or she is a suitable person to be so licensed.

The second means is on the state level through the Attorney General;
§ 11-47-18  License or permit issued by attorney general on showing of need – (a) The attorney general may issue a license or permit to any person twenty-one (21) years of age or over to carry a pistol or revolver … upon his or her person…

Two more key legal terms in Section 22 that we need to understand are “shall” and “may”.

Shall
When used in statutes of law, the term “shall” is a command of duty and is defined as "has a duty to".

May
When used in statutes of law, the term “may” is a discretionary term and is ambiguous. “May” simply extends an ability to do something, but not an obligation.
“May” means 'has discretion to,' 'is permitted to' or 'is authorized to.' Kenneth A. Adams, Legal Usage in Drafting Corporate Agreements 33 (Quorum Books 2001).

In review of RIGL 11-47-11, and RIGL 11-47-18 it is clear that the distinction between the two methods of obtaining a concealed weapons permit is that in 11-47-11, the “Town-Issued Permit” is a “shall issue” method of obtaining a permit and in 11-47-18, the “State issued permit” is a “may issue” method of obtaining a permit.

#4 – How do these legal distinctions apply to the proposal in Exeter?

Very simply put, the Town-issued permit obtained through 11-47-11 is not discretionary – it is mandatory that a town issues the permit to any qualified applicant that seeks a permit because the law clearly states that the licensing authority of that town “shall issue”. To put it into legal context, the term can be alternatively phrased as “the licensing authority of any city or town has a duty to issue”.

While many towns in the state administer this process through the police department, a town without a police department is not relieved of this obligation because 11-47-11 very clearly states that the permit is given by “the licensing authority” of a city or town. That responsibility can be delegated by the Mayor, Town Council or Town Manager to any town official with the authority to issue licenses. Typically a Town Clerk, for example, possesses such authority. It is NOT necessary that the permit be issued by the police department.

Upon examination of 11-47-18, the Attorney General “may issue” a permit.  Again, articulating this with the legal definition from above; “The Attorney General has the discretion to issue a license or permit…”

The legal distinction between the two sections of law is that the town MUST give a qualified applicant a permit, and the Attorney General has the ability, but is NOT OBLIGATED TO give a qualified applicant a permit.

#5 – Why is this proposal unconstitutional?

As elected officials on both the state and town level, we all swore an oath to support the Constitutions of both the state of RI and the United States of America.  With the 2nd Amendment stating that the “right to keep and bear arms shall not be infringed” and Article I, Section 22 of RI’s Constitution enumerating that “The right of the people to keep and bear arms shall not be infringed.”

Another legal term is the word “infringe” which is a term of common use as well as legal use that means;

verb.
1. To transgress or exceed the limits of; to violate
2. To defeat; invalidate.
* Merriam Webster

To put Section 22 into “plain speak” by inserting the legal definitions provided above, it would read;
“The right of the people to own, possess, and to carry a loaded gun outside the home, must not, and cannot be violated or invalidated.”

By eliminating the ability of Exeter residents to utilize the Town permitting process and compelling them to use the Attorney General process, then Article 1, Section 22 of Rhode Island’s Constitution will in-fact, be violated by the town of Exeter.

#6 – What would happen if this proposal became law?

If a citizen of the town of Exeter seeks to apply for a concealed weapons permit and there is no ability for them to obtain such a permit through RIGL 11-47-11 as is their right, then they have been stripped of their ability to protect themselves by eliminating their ability to execute the right of “carrying a loaded gun outside the home” which “must not, and cannot be violated or invalidated.”

Because the Attorney General process under 11-47-18 is a “may issue” process, and is completely discretionary, this method of obtaining a permit is not guaranteed, and CAN be infringed at the discretion of the Attorney General.

Therefore, the only mandated method of obtaining a permit to exercise one’s constitutionally guaranteed right to “keep and bear arms” is through 11-47-11.

If a resident of the town of Exeter seeks to obtain a permit from the town and is not allowed to, they then have legal standing to file suit against the town of Exeter for the violation of their constitutionally protected right to keep and bear arms.

If that resident sought a permit and was not be able to obtain one, and an unfortunate incident occurred and they were somehow injured, or killed because they were unable to defend themselves with a firearm, then the town could also be subject to a suit seeking compensation for damages resulting in the violation of their constitutional rights.

This could cost the town of Exeter anywhere from $50,000 to $50 million depending on the circumstances of the individual suit.

A much more reasonable approach would be for the town to simply follow the laws of our state, and issue permits in accordance with RIGL 11-47-11.

The very same “Exeter Initiative” was passed by Representative Larry Valencia in committee, and in the very last day of the 2012 legislative session he attempted to have it pass the Full House in the barrage of last minute bills that are annually jammed through the legislature in a blur.  However, I immediately noticed this bill, “item number 46” on the calendar for the House Floor.  Before session started I worked along with a couple of other reps to “whip” the room and get enough opposition to this bill that we were able to present it to the Majority Leader as an unconstitutional bill that the NRA would vehemently oppose. Through his experience with the NRA and also the type of legislation we were dealing with, the Majority Leader – to his credit – realized that this bill was a bad bill and when session convened the first words out of his mouth when we addressed the calendar were “Mr. Speaker, Item number 46 – recommit.”

This 6 word sentence killed that bill last year, but this year they are not going to go silently.

Now there is a twist to the Exeter issue.

The Rhode Island Attorney General seeks to seize control of all Concealed Weapons permits issued in the state.

I had a conversation with someone within the Attorney General’s Office who all but confirmed to me that the AG will be introducing a bill – as soon as this week – that will seek to eradicate the effect of section 11-47-11 from the books. While perhaps they will not be seeking to strike the chapter, they are seeking to implement legislation that would have the same effect as striking the entire chapter.

What does this mean? It means that we will no longer have the right to “keep and bear arms” – it will now be relegated to that of “privilege” status.  We will be required to appeal to the Attorney General for the “privilege” of carrying a person protection firearm – despite the fact that our Constitution specifically states that this is a “right that shall not be infringed” and not a privilege.

While there has been no bill yet submitted, I do not expect it to reform the current AG mechanism for CCW permits, I suspect it will simply eradicate the 11-47-11 Section of Chapter 47.

If the Attorney General were inclined to obey the Constitution he swore an oath to a mere 76 days ago, and add a “shall issue” mechanism to the permitting process, then I would support his initiative as long as it did not infringe on our right to keep and bear arms in any other way. However, from the information I have, I have very little hope that this will be the case.

This initiative, if it is introduced, needs to be fought with the vigor and power of presence that the Registration Bill (5573) was treated.

Governor Chafee’s Gun Control Initiative

Through his spokesperson the governor has announced that he will be releasing his legislative package as early as next week, or maybe the week following.

I have not seen the legislation that is in the package, but I did get a glance at some of the issues they are considering. I will not mention them because hopefully he was overcome with either common-sense or just plain reason, and did not include them in his package.

By adding one sentence the sponsor, Representative Karen MacBeth , will make criminals of any adult carrying a knife of any form and/or any length anywhere on school property. There are no provisions for trades people, first responders or even school staff.

H-5659 has made it to the House Judiciary Committee , but no date has been set to hear it.

If you email MacBeth, please be advised that she has an A+ rating from the NRA although I'm not sure if we want her in our corner based on this f#$@ed up proposal.

IIRC, RI law already has penalties for carrying a knife with a blade length over 3" (total blade extending beyond handle, not just sharpened edge), so what is the point to this idiocy?  Even the TSA is moderating their on-board knife carriage policy; why is RI needlessly going in the opposite direction.  Leave the existing knife laws as they are, and up the penalties for illegal usage of any knife or other deadly weapon.  Make the criminals suffer, not the average citizen going about his/her business.

Chaffee worries me.  He's an Obama supporter and there's no doubt in my mind that he will propose an AWB/mag limit.  I'm also worried about the way hes doing it(with the help of the police).  My guess is once the gay marriage agenda is passed the AWB is coming........and since RI is a libreal stronghold it will pass.
