Oh yeh, and don't forget motor oil - Putting some of that stuff on the road will make a police cruiser crash real quick!

Are we talking about roofing nails?

Are deputies the only ones that are at risk or is the public also vulnerable?

I understand his complaint that it can make a cruiser crash....However, wouldn't that mean they are endangering inncoent people when they use road spikes during a pursuit?  I know they can use deadly force in pursuit of a felon.  

Doesn't criminal negligence mean the should have known that using spikes could harm inncoent people?  Just double standards, nothing to see here.

Im torn...

On the one hand, I cant really see how the average law abiding person would be needing spike strips.

On the other, its more of the tired old hypocritical "they arent dangerous in our hands because we are trained"  elitist speak. We hear the same thing about handguns, military pattern rifles, tasers, pepper spray, etc etc.

Its dangerous and must be outlawed, but if the police use it then its a vital tool to help bring chases to a safe end.
The same argument could (and has) been made about firearms.

First of all, this country is not about what people need.  But the spikes in the article did not look kike the hollow spikes police use that deflate tires slowly.  These look like the were made out of big nails.

Second, just about anything can be turned into a deadly weapon with enough ingenuity.  Have you seen what inmates can do with a damn plastic spoon or bic pen on Lockup?

If we really want to become more like England, where they consider some spring powered pellet guns to be firearms, then we need to ban all stores like Home Depot because each one contains hundreds if not thousands of (potential) deadly weapons.

There is no list of deadly weapons in the penal code.  There is no place for spikes to be "listed" as deadly weapons.  The sheriff needs to educate himself.  

Here is the definition of "deadly weapon"

"17)  "Deadly weapon" means:

(A)  a firearm or anything manifestly designed, made, or adapted for the purpose of inflicting death or serious bodily injury; or

(B)  anything that in the manner of its use or intended use is capable of causing death or serious bodily injury."

In the manner of their use the definition already applies.

Hit a baseball with a baseball bat, not a deadly weapon; swing that bat at me, deadly weapoon.  Mark on my arm with an ink pen, not a deadly weapon; try to shove that pen in my neck, deadly weapon.

Throw spikes at my car to try to make me crash; deadly weapon.    There ya go Sheriff, did it for ya.   lol


And DPS and the Border Patrol have nothing to do with classifying things.

The devices used are not roofing nails, they are caltrops. And, yes, he does have a big problem with them. The cartel smugglers bring loads over, and as they speed away from the Rio Grande, if they are intercepted, they speed back to the river. They toss the devices out as they are pursued,this happens frequently.
You can imagine the frustration of the local ( and underfunded ) departments as they have to constantly buy new sets of tires.
It is different in the Valley, yesterday they had a cartel smuggler pursuit, as they caught up, a second car ( cartel folks on this side ) blocked the road with another car to allow the smuggler car time to unload and the occupants to disappear.

You would think that a large quantity of 7.62 NATO or better yet .50 cal liberally applied to the Drug Smugglers (and / or their vehicles) would get the point clear to them that running from the US Police is a VERY Bad Idea.  

Guess the Sheriff would like some M-113s to catch the bad guys.  

No Flats there with Tracks and it would make a good carrier for a .50 and some 7.62s in ACAV configuration.  

USA.Gov is giving them away to locals, so why not?

Maybe land owners / law should sprinkle some of those Caltrops at the Mexican Drug Crossing Points to beat the Cartel to the punch.  Can't be much fun to have F-250 full of drugs on the USA side and then find Juan has no rubber remaining for the road...

This deserves an update - Today the Sheriff's department goes to the house of the folks who made the caltrops, the folks weren't there, the news film crew said the neighbors " knew nothing ".
While the news crew is filming, they noticed a pickup with two guys eyeballing the whole operation. They thought it suspicious enough to write down the license plate, and give it to the officers. Plate comes back as stolen out of Houston.

totally agree, same law makes it were they can shoot a driver of a vehicle when they do not stop. (Chase or escape).

the vehicle within itself is a deadly weapon.  no need to outlaw something.  train the police in that department to shoot better.

It's an ongoing problem down here.  On one drug run they spiked 7 non-LE vehicles.  Other times they spike Border Patrol and  local LE vehicles.
