McCarthy Bill Bans Millions More Guns Than The Clinton Gun Ban

On Feb. 14, 2007, Representative Carolyn McCarthy (D-N.Y.) introduced H.R. 1022, a bill with the stated purpose, "to reauthorize the assault weapons ban, and for other purposes."  This is also  SB 43  - Senate Bill.

McCarthy's verbiage warrants explanation. Presumably, what she means by "assault weapons ban" is the Clinton Gun Ban of 1994.  Congress allowed the ban to expire in 2004 for multiple reasons, including the fact that federal, state and local law enforcement agency studies showed that guns affected by the ban had been used in only a small percentage of crime, before and after the ban was imposed.

With the nation's murder rate 43% lower than in 1991, and the re-legalized guns still used in only a small percentage of crime, reauthorizing the Clinton Gun Ban would be objectionable enough. But McCarthy's "other purposes" would make matters even worse.  H.R. 1022 would ban every gun banned by the Clinton ban, plus millions more guns, including:

. Every gun made to comply with the Clinton ban. (The Clinton ban dictated the kinds of grips, stocks and attachments new guns could have. Manufacturers modified new guns to the Clinton requirements. H.R. 1022 would ban the modified guns too.)

. Guns exempted by the Clinton ban. (Ruger Mini-14s and -30s and Ranch Rifles; .30 cal. carbines; and fixed-magazine, semi-automatic, center-fire rifles that hold more than 10 rounds.)

. All semi-automatic shotguns. (E.g., Remington, Winchester, Beretta and Benelli, used for hunting, sport shooting, and self-defense.  H.R. 1022 would ban them because they have "any characteristic that can function as a grip," and would also ban their main component, called the "receiver.")

. All detachable-magazine semi-automatic rifles-including, for example, the ubiquitous Ruger 10/22 .22 rimfire-because they have "any characteristic that can function as a grip."

. Target shooting rifles. (E.g., the three centerfire rifles most popular for marksmanship competitions: the Colt AR-15, the Springfield M1A and the M1 "Garand.")

. Any semi-automatic shotgun or rifle an Attorney General one day claims isn't "sporting," even though the constitutions of the U.S. and 44 states, and the laws of all 50 states, recognize the right to use guns for defense.

. 65 named guns (the Clinton law banned 19 by name); semi-auto fixed-magazine pistols of over 10 rounds capacity; and frames, receivers and parts used to repair or refurbish guns.

H.R. 1022 would also ban the importation of magazines exempted by the Clinton ban, ban the sale of a legally-owned "assault weapon" with a magazine of over 10 rounds capacity, and begin backdoor registration of guns, by requiring private sales of banned guns, frames, receivers and parts to be conducted through licensed dealers.  Finally, whereas the Clinton Gun Ban was imposed for a 10-year trial period, H.R. 1022 would be a permanent ban.

THis has already been beat to death on every gun forum on the Internet.  Basically the bill sponsor has a terrible record of introducing bills, but she hardly ever gets her bills out of committee, let alone passed.

someone who would really speak out and be heard would be any of the Hunting, firearm companys who supported these eleceted officals with donations to come out and use Zumbo as a example in a letter to let them know how the community feels as whole about the Clinton / Brady / Mcarthy regiems and their view of the black rifles. i would say that the Clintion administration redefined Assault weapons to include certian models of firearm, and others similar based only on their  cosmetic looks with no real function difference. and in order to get to the point where an AW Ban would be considered they had to put fear into the poplation by disturbing the status quo of Americans having the liberty of the 2nd amendment and that certian firearms that never before needed to be regulated by the goverment because they created no real concern now need regulating becsaue they want to blame a certian firearms on its cosmestic appearance, before the Clintion era Assualt Weapons were only really considered to be full auto or select fire rifles. and a semiautomatic was just another regular rifle. the only real firearms that were feard were the full autos and concealable SBR and SBS, and real destructive devices which became our NFA and 68 gun control act.

The Brady / Clinton / Mcarthy campaiagn put fear which never before exhisited in the american population, to the point of making false aqusations and statements about firearms to disrupt the status quo only to strike fear and terror into the citizens for their own personal ideological goals and personal conflicts with firearms, to attack our 2nd ammendment rights. why must these people attempt to force political change by convincing the population to fear a future harm or fear of a future harm in order to change and irradicate the American Status quo of life and liberitys

instead of dealing with the real problem which is our population and the every day life we give for individuals to live, if we breed a culture of criminals, we will have nothing but common bread criminals in the end no matter of what means they choose to the enviroment is the pushing factor not the means.....

Which can be at least partially attributed to our letters, phone calls, and e-mails.  

I contacted Stupak several days ago and specifically asked about HR #1022 and asked him not to sponsor it. My reply from him never  even mentions this bill.
Oh well, at least it looks like the bill is dead anyway.

February 26, 2007 Thank you for contacting me about our nation's gun laws.  I understand and appreciate your point of view on this issue, and I am glad to have this opportunity to respond to you. I have always spoken out in defense of the Second Amendment rights of American citizens.  The vast majority of gun owners are responsible sports men and women who like to hunt and sport shoot, which are essential parts of our state's economy and our cultural heritage.  While gun safety is essential, taking guns away from law-abiding citizens is not the answer to our nation's crime problems. On September 26th, 2006, I voted in favor of HR 5092, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) Modernization and Reform Act.  This bill will improve oversight of BATFE operations and prevent local gun dealers from having their licenses revoked for paperwork errors or other minor infractions.  HR 5092 will help to protect gun owners from overly aggressive BATFE "sting" operations and other abuses, and I hope to see it pass the Senate and be signed into law this year. In addition, I am continuing to work to protect the right of ordinary citizens to bear arms.  I oppose the idea of a national gun registry, and I strongly believe that gun regulation should be controlled by American voters, rather than international organizations like the United Nations.  The right of individuals to own guns is guaranteed by the Constitution, and I will continue to work to protect that right.
